1 AMENDMENT TO SENATE BILL 2214
2 AMENDMENT NO. . Amend Senate Bill 2214, AS AMENDED,
3 by inserting after the end of Article 10 the following:
4 "ARTICLE 20
5 Section 20-1. The Director of the Department of Natural
6 Resources, on behalf of the State of Illinois, is authorized
7 to Convey and Quit Claim unto the City of Granite City, an
8 Illinois unit of local government, its successors and
9 assigns, for and in consideration of $1.00 paid to said
10 Department, a non-exclusive, unobstructed, perpetual easement
11 for the purpose of constructing, installing, or laying, and
12 thereafter using, operating, inspecting, repairing,
13 maintaining, and replacing a storm water ditch or sewer on,
14 over, under, and across all or part of the following
15 described real property, subject to such conditions as may be
16 deemed necessary by said Department to protect the public
17 interest, to wit:
18 An 80-foot wide tract of land being 40 feet wide on
19 either side of a centerline located in the West Half of
20 Section 15, Township 3 North, Range 9 West of the Third
21 Principal Meridian, Madison County, Illinois, said
22 centerline being more fully described as follows:

1 Commencing at the Southeast corner of the Northwest
2 Quarter of the Northwest Quarter of said Section 15;
3 thence North along the East line of said Northwest
4 Quarter of the Northwest Quarter of Section 15, a
5 distance of 574.2 feet to a point on the southeasterly
6 right-of-way line of the former Nickel Plate Railroad;
7 thence Southwesterly along said right-of-way line, a
8 distance of 69.04 feet to a point on the centerline of a
9 tract of land conveyed to the Alton and Southern Railroad
10 Company by deed recorded in Book 550, Page 167 in the
11 records of Madison County, Illinois, and being the Point
12 of Beginning of the centerline being described; thence
13 South along the centerline of said tract conveyed to the
14 Alton and Southern Railroad Company, a distance of 2700
15 feet, more or less, to a point on the Northerly shoreline
16 of Horseshoe Lake, being the Termination Point of the
17 centerline being described;
18 Said 80-foot wide tract being bounded on the North
19 by the Southeasterly right-of-way line of the former
20 Nickel Plate Railroad, and on the South by the Northerly
21 shoreline of Horseshoe Lake.
22 Section 20-900. The Director of Natural Resources shall
23 obtain a certified copy of the portions of this Act
24 containing the title, enacting clause, the effective date,
25 the appropriate Section or Sections containing the land
26 descriptions of the property to be transferred or otherwise
27 affected under this Article, and this Section within 60 days
28 after its effective date and, upon receipt of the payment
29 required by the Section or Sections, if any payment is
30 required, shall record the certified document in the
31 Recorder's Office in the county in which the land is located.

1 Section 25-5. The Director of the Department of Natural
2 Resources, on behalf of the State of Illinois, is authorized
3 to execute and deliver to the Plainfield Township Park
4 District, for and in consideration of $1 paid to said
5 Department, a quit claim deed to the following described real
6 property, to wit:
7 TRACT IA (EAST):
8 That part of the following described parcel lying North
9 of the Indian Boundary Line of the North 22 chains of the
10 Northwest fractional 1/4 of Section 3, in Township 36
11 North and in Range 9 East of the Third Principal
12 Meridian, described as follows:
13 Commencing at a point 22 chains South of the Northwest
14 corner of said Northwest fractional 1/4 of Section 3,
15 thence East parallel with the North line of said Section
16 3, (North 90 degrees East) 975.64 feet, to a point of

21 That part of the West 1/2 of the Northeast 1/4 of said
22 Section 3, lying West of the center thread of the DuPage
23 River, in Township 36 North and in Range 9 East of the
24 Third Principal Meridian;
25 Containing in all 74.771 acres, more or less, all
26 situated in Will County, Illinois.
27 Section 25-10. The conveyance of real property
28 authorized by Section 25-5 shall be made subject to the
29 condition that said real property shall be used for the
30 promotion, protection and preservation of wildlife and the
31 setting aside of the real property for open space and outdoor
32 recreational activities specifically that the part of the
33 74.771 acres lying in the flood plain and adjacent to the

1 DuPage River shall be set aside and left as best it can in
2 its natural state, though permitting its limited development
3 with walking and hiking paths and that that part of the
4 74.771 acres lying west of the west flood plain line adjacent
5 to the DuPage River may be used for open space and outdoor
6 recreational activities, including the construction of
7 parking lots, washrooms, picnic grounds and outdoor
8 recreational facilities and buildings ancillary thereto,
9 reference being had to that Order of Distribution and
10 Settlement entered May 14, 1997, in the Circuit Court of the
11 12th Judicial Circuit, Will County, Illinois, in Case Number
12 95-PE-3202.

14 Section 30-10. The Director of Natural Resources, on
15 behalf of the State of Illinois, is authorized to execute and
16 deliver to Elmer L. Hamson, his successors and assigns, for
17 and in consideration of $8,580.00 paid to said Department, a
18 quit claim deed to the following described real property, to
19 wit:
20 Parcel 1: A strip of land 160 feet in width, described as
21 follows: Beginning at the Southeast corner of the
22 Southeast Quarter of the Southwest Quarter of Section 11;
23 thence North, a distance of 1478.41 feet to a point on
24 the South line of the existing township road right of
25 way; thence running North 55 degrees 4 minutes West along
26 said South line of the township road right of way a
27 distance of 195.16 feet to a point; thence running South
28 to the South line of the Southeast Quarter of the
29 Southwest Quarter; thence East 160 feet to the point of
30 beginning; ALSO, a strip of land 160 feet in width
31 extending over and across the East 3/4ths of the North
32 Half of the Southwest Quarter of Section 11, the South

21 deliver to Harold Haile, his successors and assigns, for and
22 in consideration of $3,460.00 paid to said Department, a quit
23 claim deed to the following described real property, to wit:
24 Parcel 2: A strip of land 160 feet in width extending
25 over and across the Southwest Quarter of the Northwest
26 Quarter of Section 11, running in a Southeasterly
27 direction, the South line of same being the South line of
28 the existing township road right of way, said 160 foot
29 strip being more particularly described as follows:
30 Beginning at a point being 627 feet South of the
31 Northwest corner of the Southwest Quarter of the
32 Northwest Quarter of Section 11, said point being on the
33 South line of the existing township road right of way;

1 thence running South 55 degrees 4 minutes East along said
2 South line of the township road right of way, a distance
3 of 1193.93 feet to a point on the South line of the
4 Southwest Quarter of the Northwest Quarter of said

6 point; thence running North 55 degrees 4 minutes West to
7 the West line of the Southwest Quarter of the Northwest
8 Quarter of said Section 11 at a point being 195.16 feet
