1 AN ACT concerning environmental protection.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended
5 by changing and renumbering Section 58.15 (as added by Public
6 Act 91-442) as follows:
7 (415 ILCS 5/58.16)
8 Sec. 58.16. 58.15. Construction of school; requirements.
9 This Section applies only to counties with a population of
10 more than 3,000,000. In this Section, "school" means any
11 public school located in whole or in part in a county with a
12 population of more than 3,000,000 a school as defined in
13 Section 34-1.1 of the School Code. No person shall commence
14 construction on real property of a building intended for use
15 as a school unless:
16 (1) a Phase 1 Environmental Audit, conducted
17 in accordance with Section 22.2 of this Act, is
18 obtained;
19 (2) if the Phase 1 Environmental Audit
20 discloses the presence or likely presence of a
21 release or a substantial threat of a release of a
22 regulated substance at, on, to, or from the real
23 property, a Phase II Environmental Audit, conducted
24 in accordance with Section 22.2 of this Act, is
25 obtained; and
26 (3) if the Phase II Environmental Audit
27 discloses the presence or likely presence of a
28 release or a substantial threat of a release of a
29 regulated substance at, on, to, or from the real
30 property, and (i) the real property is enrolled in
31 the Site Remediation Program, and (ii) the remedial

1 action plan is approved by that the Agency, if a
2 remedial action plan is required by Board
3 regulations. approves for the intended use of the
4 property is completed.
5 No person shall cause or allow any person to occupy a
6 building intended to be used as a school for which a remedial
7 action plan is required by Board regulations unless all work
8 pursuant to the remedial action plan is completed.

10 Section 99. Effective date. This Act takes effect upon
11 becoming law.
