1 AMENDMENT TO SENATE BILL 1180
2 AMENDMENT NO. . Amend Senate Bill 1180, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
5 "Section 5. The Environmental Protection Act is amended
6 by changing and renumbering Section 58.15 (as added by Public
7 Act 91-442) as follows:
8 (415 ILCS 5/58.16)
9 Sec. 58.16. 58.15. Construction of school; requirements.
10 This Section applies only to counties with a population of
11 more than 3,000,000. In this Section, "school" means any
12 public school located in whole or in part in a county with a
13 population of more than 3,000,000 a school as defined in
14 Section 34-1.1 of the School Code. No person shall commence
15 construction on real property of a building intended for use
16 as a school unless:
17 (1) a Phase 1 Environmental Audit, conducted
18 in accordance with Section 22.2 of this Act, is
19 obtained;
20 (2) if the Phase 1 Environmental Audit
21 discloses the presence or likely presence of a
22 release or a substantial threat of a release of a

1 regulated substance at, on, to, or from the real
2 property, a Phase II Environmental Audit, conducted
3 in accordance with Section 22.2 of this Act, is
4 obtained; and
5 (3) if the Phase II Environmental Audit
6 discloses the presence or likely presence of a
7 release or a substantial threat of a release of a
8 regulated substance at, on, to, or from the real
9 property, and (i) the real property is enrolled in
10 the Site Remediation Program, and (ii) the remedial
11 action plan is approved by that the Agency, if a
12 remedial action plan is required by Board
13 regulations. approves for the intended use of the
14 property is completed.
15 No person shall cause or allow any person to occupy a
16 building intended to be used as a school for which a remedial
17 action plan is required by Board regulations unless all work
18 pursuant to the remedial action plan is completed.

20 Section 99. Effective date. This Act takes effect upon
21 becoming law.".
