2 NINETY-SECOND GENERAL ASSEMBLY

4 Senate Joint Resolution No. 58
5 Offered by Senators Rauschenberger, Syverson,
6 Trotter and Ronen
7 WHEREAS, Medical instruments are continuously being used
8 outside the medical or hospital setting by patients; and
9 WHEREAS, Many citizens have conditions, illnesses or
10 diseases that require the use of medical instruments such as
11 sterile hypodermic syringes or needles; and
12 WHEREAS, The Illinois laws concerning the availability
13 and use of medical instruments were enacted when most medical
14 procedures and treatments were done in an office or hospital
15 and do not address disease prevention; therefore, be it
16 RESOLVED, BY THE SENATE OF THE NINETY-SECOND GENERAL
17 ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF
18 REPRESENTATIVES CONCURRING HEREIN, that there is created the
19 Commission on Medical Instruments; this Commission shall
20 review scientific literature regarding availability of
21 sterile hypodermic syringes and needles and disease
22 prevention and other available information and make
23 recommendation to the Illinois General Assembly on
24 appropriate standards for the sale and possession of sterile
25 hypodermic syringes and needles; and be it further
26 RESOLVED, That the Commission shall include one
27 representative from the following organizations: Allied Waste
28 Industries, the AIDS Foundation of Chicago, the Chicago
29 Department of Public Health, the Cook County Department of
30 Public Health, the Cook County State's Attorney's Office, the
31 Illinois Academy of Family Physicians, Illinois Chapter, the
32 American Academy of Pediatricians, the Illinois Department of
33 Public Health, the Illinois Family Institute, the Illinois

1 Nurses Association, the Illinois Pharmacists Association, the
2 Illinois Public Health Association, the Illinois Retail
3 Merchants Association, the Illinois State Medical Society,
4 the Illinois Department of State Police, and the Illinois
5 State's Attorneys Association; and be it further
6 RESOLVED, That the Commission shall conduct at least 2
7 public hearings, one in Chicago and one in Springfield; and
8 be it further
9 RESOLVED, That the members of the Commission shall adopt
10 bylaws and elect a chairperson; members of the Commission
11 shall serve without compensation; the Illinois Department of
12 Public Health shall provide administrative support for the
13 Commission; and be it further
14 RESOLVED, That the Commission shall report its
15 recommendations to the General Assembly and Governor on or
16 before December 1, 2002.
