1 SENATE JOINT RESOLUTION
2 WHEREAS, Medical instruments are continuously being used
3 outside the medical or hospital setting by patients; and
4 WHEREAS, Many citizens have conditions, illnesses or
5 diseases that require the use of medical instruments such as
6 sterile hypodermic syringes or needles; and
7 WHEREAS, The Illinois laws concerning the availability
8 and use of medical instruments were enacted when most medical
9 procedures and treatments were done in an office or hospital
10 and do not address disease prevention; therefore, be it
11 RESOLVED, BY SENATE OF THE NINETY-SECOND GENERAL ASSEMBLY
12 OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
13 CONCURRING HEREIN, that there is created the Commission on
14 Medical Instruments; this Commission shall review scientific
15 literature regarding availability of sterile hypodermic
16 syringes and needles and disease prevention and other
17 available information and make recommendation to the Illinois
18 General Assembly on appropriate standards for the sale and
19 possession of sterile hypodermic syringes and needles; and be
20 it further
21 RESOLVED, That the Commission shall include one
22 representative from the following organizations: the AIDS
23 Foundation of Chicago, the Chicago Department of Public
24 Health, the Cook County Department of Public Health, the Cook
25 County States Attorney's Office, the Illinois Academy of
26 Family Physicians, Illinois Chapter, the American Academy of
27 Pediatricians, the Illinois Department of Public Health, the
28 Illinois Family Institute, the Illinois Nurses Association,
29 the Illinois Pharmacists Association, the Illinois Public
30 Health Association, the Illinois Retail Merchants
31 Association, the Illinois State Medical Society, the Illinois
32 Department of State Police, and the Illinois States

1 Attorney's Association; and be it further
2 RESOLVED, That the Commission shall conduct at least 2
3 public hearings, one in Chicago and one in Springfield; and
4 be it further
5 RESOLVED, That the members of the Commission shall adopt
6 bylaws and elect a chairperson; members of the Commission
7 shall serve without compensation; the Illinois Department of
8 Public Health shall provide administrative support for the
9 Commission; and be it further
10 RESOLVED, That the Commission shall report its
11 recommendations to the General Assembly and Governor on or
12 before December 1, 2002
