Pursuant to Article IV, Section 9(b) of the Illinois
Constitution of 1970, I hereby veto Senate Bill 1982 entitled
"AN ACT concerning prisons."
Senate Bill 1982 amends the Unified Code of Corrections
to provide that the additional charge for commissary goods in
prisons shall be up to 35% for tobacco products and 25% for
non-tobacco products. The additional charge shall be based
upon the amount necessary to cover wages and benefits of
employees of commissaries who are covered by a collective
bargaining agreement. Forty percent of the profits on sales
from commissary stores shall be expended by the Department of
Corrections for the special benefit of committed persons.
The remainder must be used first to pay for wages and
benefits of commissary employees covered by a collective
bargaining agreement, and then to pay the costs of dietary
staff.
The Department of Corrections' budget that I received and
approved assumes that privatization of the dietary and
commissary services will occur. When the Department
privatizes its dietary and commissary services, employees
working in those areas will be directly employed by the
contract vendor, which will render the provisions of Senate
Bill 1982 unnecessary.
For this reason, I hereby veto and return Senate Bill
1982.
