1 AN ACT concerning intergovernmental cooperation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Intergovernmental Cooperation Act is
5 amended by changing Section 6 as follows:
6 (5 ILCS 220/6) (from Ch. 127, par. 746)
7 Sec. 6. Joint self-insurance. An intergovernmental
8 contract may, among other undertakings, authorize public
9 agencies to jointly self-insure and authorize each public
10 agency member of the contract to utilize its funds to pay to
11 a joint insurance pool its costs and reserves to protect,
12 wholly or partially, itself or any public agency member of
13 the contract against liability or loss in the designated
14 insurable area. A joint insurance pool shall have an annual
15 audit performed by an independent certified public accountant
16 and shall file an annual audited financial report with the
17 Director of Insurance no later than 150 days after the end of
18 the pool's immediately preceding fiscal year. The Director
19 of Insurance shall issue rules necessary to implement this
20 audit and report requirement. The rule shall establish the
21 due date for filing the initial annual audited financial
22 report. Within 30 days after January 1, 1991, and within 30
23 days after each January 1 thereafter, public agencies that
24 are jointly self-insured to protect against liability under
25 the Workers' Compensation Act and the Workers' Occupational
26 Diseases Act shall file with the Industrial Commission a
27 report indicating an election to self-insure.
28 For purposes of this Section, "public agency member"
29 means any public agency defined or created under this Act,
30 any local public entity as defined in Section 1-206 of the
31 Local Governmental and Governmental Employees Tort Immunity

1 Act, and any public agency, authority, instrumentality,
2 council, board, service region, district, unit, bureau, or,
3 commission, or any municipal corporation, college, or
4 university, whether corporate or otherwise, and any other
5 local governmental body or similar entity that is presently
6 existing or created after the effective date of this
7 amendatory Act of the 92nd General Assembly, whether or not
8 specified in this Section. Only public agency members with
9 tax receipts, tax revenues, taxing authority, or other
10 resources sufficient to pay costs and to service debt related
11 to intergovernmental activities described in this Section, or
12 public agency members created by or as part of a public
13 agency with these powers, may enter into contracts or
14 otherwise associate among themselves as permitted in this
15 Section.

17 Section 99. Effective date. This Act takes effect upon
18 becoming law.
