 1                    AMENDMENT TO SENATE BILL 390

 2        AMENDMENT NO.     .  Amend Senate Bill  390  on  page  1,
 3    line 22, after the period, by inserting the following:
 4    "No  person  shall  be liable for civil damages or subject to
 5    professional discipline based  on  a  claim  of  violating  a
 6    patient's  right  to  confidentiality as a result of making a
 7    reasonable inquiry as to  the  availability  of  a  patient's
 8    family  member  or  health  care agent, except for willful or
 9    wanton misconduct.".
