1 AN ACT concerning vehicles.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by
5 changing Section 11-310 as follows:
6 (625 ILCS 5/11-310) (from Ch. 95 1/2, par. 11-310)
7 Sec. 11-310. Display of unauthorized signs, signals, or
8 markings.
9 (a) No person shall place, maintain or display upon or
10 in view of any highway any unauthorized sign, signal,
11 marking, or device which purports to be or is an imitation of
12 or resembles an official traffic-control device or railroad
13 sign or signal, or which attempts to direct the movement of
14 traffic, or which hides from view or interferes with the
15 movement of traffic or the effectiveness of an official
16 traffic-control device or any railroad sign or signal.
17 (b) No person shall place or maintain nor shall any
18 public authority permit upon any highway any traffic sign or
19 signal bearing thereon any commercial advertising.
20 (c) Every such prohibited sign, signal or marking is
21 hereby declared to be a public nuisance and the authority
22 having jurisdiction over the highway is hereby empowered to
23 remove the same or cause it to be removed without notice.
24 (d) No person shall sell or offer for sale any traffic
25 control device to be used on any street or highway in this
26 State which does not conform to the requirements of this
27 Chapter.
28 (e) This Section shall not be deemed to prohibit the
29 erection upon private property adjacent to highways of signs
30 giving useful directional information and of a type that
31 cannot be mistaken for official signs.

1 (f) This Section shall not be deemed to prohibit the
2 erection of Illinois Adopt-A-Highway signs by municipalities,
3 townships, or counties as provided in the Illinois
4 Adopt-A-Highway Act.
5 (f-1) This Section does not prohibit a municipality from
6 placing and displaying along or over a highway a sign or
7 banner if the following conditions are met:
8 (1) The sign or banner honors community or student
9 achievements and bears no commercial advertising.
10 (2) The sign or banner is of a size no greater than
11 30 square feet.
12 (3) The sign or banner does not obstruct or
13 endanger traffic or obstruct the view of the driver of
14 any vehicle.
15 (4) The sign or banner remains in place no more
16 than 30 days.
17 (5) The municipality obtains the approval of the
18 Department before placing a sign or banner along or over
19 any highway under the jurisdiction of the Department.
20 The Department must respond with approval or denial
21 within 7 days of receiving a municipality's request for
22 approval under paragraph (5) of this subsection (f-1).
23 (g) Any person failing to comply with this Section shall
24 be guilty of a Class A misdemeanor.

26 Section 99. Effective date. This Act takes effect July
27 1, 2002.
