1 AMENDMENT TO HOUSE BILL 234
2 AMENDMENT NO. . Amend House Bill 234 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Medical Practice Act of 1987 is amended
5 by changing Section 18 as follows:
6 (225 ILCS 60/18) (from Ch. 111, par. 4400-18)
7 Sec. 18. Visiting professor, physician, or resident
8 permits.
9 (A) Visiting professor permit.
10 (1) A visiting professor permit shall entitle a
11 person to practice medicine in all of its branches or to
12 practice the treatment of human ailments without the use
13 of drugs and without operative surgery provided:
14 (a) the person maintains an equivalent
15 authorization to practice medicine in all of its
16 branches or to practice the treatment of human
17 ailments without the use of drugs and without
18 operative surgery in good standing in their native
19 licensing jurisdiction during the period of the
20 visiting professor permit; and
21 (b) the person has received a faculty
22 appointment to teach in a medical, osteopathic or

1 chiropractic school in Illinois; and.
2 (c) the Department may prescribe the
3 information necessary to establish an applicant's
4 eligibility for a permit. This information shall
5 include without limitation (i) a statement from the
6 dean of the medical school at which the applicant
7 will be employed describing the applicant's
8 qualifications and (ii) a statement from the dean of
9 the medical school listing every affiliated
10 institution in which the applicant will be providing
11 instruction as part of the medical school's
12 education program and justifying any clinical
13 activities at each of the institutions listed by the
14 dean.
15 (2) Application for visiting professor permits
16 shall be made to the Department, in writing, on forms
17 prescribed by the Department and shall be accompanied by
18 the required fee established by rule, which shall not be
19 refundable. Any application shall require the
20 information as, in the judgment of the Department, will
21 enable the Department to pass on the qualifications of
22 the applicant.
23 (3) A visiting professor permit shall be valid for
24 no longer than 2 years one year from the date of issuance
25 or until the time the faculty appointment is terminated,
26 whichever occurs first, and may be renewed only in
27 accordance with subdivision (A)(6) of this Section once.
28 (4) The applicant may be required to appear before
29 the Medical Licensing Board for an interview prior to,
30 and as a requirement for, the issuance of the original
31 permit and the renewal.
32 (5) Persons holding a permit under this Section
33 shall only practice medicine in all of its branches or
34 practice the treatment of human ailments without the use

1 of drugs and without operative surgery in the State of
2 Illinois in their official capacity under their contract
3 within the medical school itself and any affiliated
4 institution in which the permit holder is providing
5 instruction as part of the medical school's educational
6 program and for which the medical school has assumed
7 direct responsibility.
8 (6) A visiting professor permit shall be valid
9 until the last day of the next physician license renewal
10 period, as set by rule, and may only be renewed for
11 applicants who meet the following requirements:
12 (i) have obtained the required continuing
13 education hours as set by rule; and
14 (ii) have paid the fee prescribed for a
15 license under Section 21 of this Act.
16 For initial renewal, the visiting professor must
17 successfully pass a general competency examination authorized
18 by the Department by rule.
19 (B) Visiting physician permit.
20 (1) The Department may, in its discretion, issue a
21 temporary visiting physician permit, without examination,
22 provided:
23 (a) (blank);
24 (b) that the person maintains an equivalent
25 authorization to practice medicine in all of its
26 branches or to practice the treatment of human
27 ailments without the use of drugs and without
28 operative surgery in good standing in his or her
29 native licensing jurisdiction during the period of
30 the temporary visiting physician permit;
31 (c) that the person has received an invitation
32 or appointment to study, demonstrate, or perform a
33 specific medical, osteopathic, chiropractic or
34 clinical subject or technique in a medical,

1 osteopathic, or chiropractic school, a hospital
2 licensed under the Hospital Licensing Act, a
3 hospital organized under the University of Illinois
4 Hospital Act, or a facility operated pursuant to the
5 Ambulatory Surgical Treatment Center Act; and
6 (d) that the temporary visiting physician
7 permit shall only permit the holder to practice
8 medicine in all of its branches or practice the
9 treatment of human ailments without the use of drugs
10 and without operative surgery within the scope of
11 the medical, osteopathic, chiropractic, or clinical
12 studies for which the holder was invited or
13 appointed.
14 (2) The application for the temporary visiting
15 physician permit shall be made to the Department, in
16 writing, on forms prescribed by the Department, and shall
17 be accompanied by the required fee established by rule,
18 which shall not be refundable. The application shall
19 require information that, in the judgment of the
20 Department, will enable the Department to pass on the
21 qualification of the applicant, and the necessity for the
22 granting of a temporary visiting physician permit.
23 (3) A temporary visiting physician permit shall be
24 valid for 180 days from the date of issuance or until the
25 time the medical, osteopathic, chiropractic, or clinical
26 studies are completed, whichever occurs first.
27 (4) The applicant for a temporary visiting
28 physician permit may be required to appear before the
29 Medical Licensing Board for an interview prior to, and as
30 a requirement for, the issuance of a temporary visiting
31 physician permit.
32 (5) A limited temporary visiting physician permit
33 shall be issued to a physician licensed in another state
34 who has been requested to perform emergency procedures in

1 Illinois if he or she meets the requirements as
2 established by rule.
3 (C) Visiting resident permit.
4 (1) The Department may, in its discretion, issue a
5 temporary visiting resident permit, without examination,
6 provided:
7 (a) (blank);
8 (b) that the person maintains an equivalent
9 authorization to practice medicine in all of its
10 branches or to practice the treatment of human
11 ailments without the use of drugs and without
12 operative surgery in good standing in his or her
13 native licensing jurisdiction during the period of
14 the temporary visiting resident permit;
15 (c) that the applicant is enrolled in a
16 postgraduate clinical training program outside the
17 State of Illinois that is approved by the
18 Department;
19 (d) that the individual has been invited or
20 appointed for a specific period of time to perform a
21 portion of that post graduate clinical training
22 program under the supervision of an Illinois
23 licensed physician in an Illinois patient care
24 clinic or facility that is affiliated with the
25 out-of-State post graduate training program; and
26 (e) that the temporary visiting resident
27 permit shall only permit the holder to practice
28 medicine in all of its branches or practice the
29 treatment of human ailments without the use of drugs
30 and without operative surgery within the scope of
31 the medical, osteopathic, chiropractic or clinical
32 studies for which the holder was invited or
33 appointed.
34 (2) The application for the temporary visiting

1 resident permit shall be made to the Department, in
2 writing, on forms prescribed by the Department, and shall
3 be accompanied by the required fee established by rule.
4 The application shall require information that, in the
