1 AN ACT to amend the Medical Practice Act of 1987.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Medical Practice Act of 1987 is amended
5 by changing Section 18 as follows:
6 (225 ILCS 60/18) (from Ch. 111, par. 4400-18)
7 Sec. 18. Visiting professor, physician, or resident
8 permits.
9 (A) Visiting professor permit.
10 (1) A visiting professor permit shall entitle a
11 person to practice medicine in all of its branches or to
12 practice the treatment of human ailments without the use
13 of drugs and without operative surgery provided:
14 (a) the person maintains an equivalent
15 authorization to practice medicine in all of its
16 branches or to practice the treatment of human
17 ailments without the use of drugs and without
18 operative surgery in good standing in their native
19 licensing jurisdiction during the period of the
20 visiting professor permit; and
21 (b) the person has received a faculty
22 appointment to teach in a medical, osteopathic or
23 chiropractic school in Illinois; and.
24 (c) the Department may prescribe the
25 information necessary to establish an applicant's
26 eligibility for a permit. This information shall
27 include without limitation (i) a statement from the
28 dean of the medical school at which the applicant
29 will be employed describing the applicant's
30 qualifications and (ii) a statement from the dean of
31 the medical school listing every affiliated

1 institution in which the applicant will be providing
2 instruction as part of the medical school's
3 education program and justifying any clinical
4 activities at each of the institutions listed by the
5 dean.
6 (2) Application for visiting professor permits
7 shall be made to the Department, in writing, on forms
8 prescribed by the Department and shall be accompanied by
9 the required fee established by rule, which shall not be
10 refundable. Any application shall require the
11 information as, in the judgment of the Department, will
12 enable the Department to pass on the qualifications of
13 the applicant.
14 (3) A visiting professor permit shall be valid for
15 no longer than 2 years one year from the date of issuance
16 or until the time the faculty appointment is terminated,
17 whichever occurs first, and may be renewed only in
18 accordance with subdivision (A)(6) of this Section once.
19 (4) The applicant may be required to appear before
20 the Medical Licensing Board for an interview prior to,
21 and as a requirement for, the issuance of the original
22 permit and the renewal.
23 (5) Persons holding a permit under this Section
24 shall only practice medicine in all of its branches or
25 practice the treatment of human ailments without the use
26 of drugs and without operative surgery in the State of
27 Illinois in their official capacity under their contract
28 within the medical school itself and any affiliated
29 institution in which the permit holder is providing
30 instruction as part of the medical school's educational
31 program and for which the medical school has assumed
32 direct responsibility.
33 (6) A visiting professor permit shall be valid
34 until the last day of the next physician license renewal

1 period, as set by rule, and may only be renewed for
2 applicants who meet the following requirements:
3 (i) have obtained the required continuing
4 education hours as set by rule; and
5 (ii) have paid the fee prescribed for a
6 license under Section 21 of this Act.
7 For initial renewal, the visiting professor must
8 successfully pass a general competency examination authorized
9 by the Department by rule.
10 (B) Visiting physician permit.
11 (1) The Department may, in its discretion, issue a
12 temporary visiting physician permit, without examination,
13 provided:
14 (a) (blank);
15 (b) that the person maintains an equivalent
16 authorization to practice medicine in all of its
17 branches or to practice the treatment of human
18 ailments without the use of drugs and without
19 operative surgery in good standing in his or her
20 native licensing jurisdiction during the period of
21 the temporary visiting physician permit;
22 (c) that the person has received an invitation
23 or appointment to study, demonstrate, or perform a
24 specific medical, osteopathic, chiropractic or
25 clinical subject or technique in a medical,
26 osteopathic, or chiropractic school, a hospital
27 licensed under the Hospital Licensing Act, a
28 hospital organized under the University of Illinois
29 Hospital Act, or a facility operated pursuant to the
30 Ambulatory Surgical Treatment Center Act; and
31 (d) that the temporary visiting physician
32 permit shall only permit the holder to practice
33 medicine in all of its branches or practice the
34 treatment of human ailments without the use of drugs

1 and without operative surgery within the scope of
2 the medical, osteopathic, chiropractic, or clinical
3 studies for which the holder was invited or
4 appointed.
5 (2) The application for the temporary visiting
6 physician permit shall be made to the Department, in
7 writing, on forms prescribed by the Department, and shall
8 be accompanied by the required fee established by rule,
9 which shall not be refundable. The application shall
10 require information that, in the judgment of the
11 Department, will enable the Department to pass on the
12 qualification of the applicant, and the necessity for the
13 granting of a temporary visiting physician permit.
14 (3) A temporary visiting physician permit shall be
15 valid for 180 days from the date of issuance or until the
16 time the medical, osteopathic, chiropractic, or clinical
17 studies are completed, whichever occurs first.
18 (4) The applicant for a temporary visiting
19 physician permit may be required to appear before the
20 Medical Licensing Board for an interview prior to, and as
21 a requirement for, the issuance of a temporary visiting
22 physician permit.
23 (5) A limited temporary visiting physician permit
24 shall be issued to a physician licensed in another state
25 who has been requested to perform emergency procedures in
26 Illinois if he or she meets the requirements as
27 established by rule.
28 (C) Visiting resident permit.
29 (1) The Department may, in its discretion, issue a
30 temporary visiting resident permit, without examination,
31 provided:
32 (a) (blank);
33 (b) that the person maintains an equivalent
34 authorization to practice medicine in all of its

1 branches or to practice the treatment of human
2 ailments without the use of drugs and without
3 operative surgery in good standing in his or her
4 native licensing jurisdiction during the period of
5 the temporary visiting resident permit;
6 (c) that the applicant is enrolled in a
7 postgraduate clinical training program outside the
8 State of Illinois that is approved by the
9 Department;
10 (d) that the individual has been invited or
11 appointed for a specific period of time to perform a
12 portion of that post graduate clinical training
13 program under the supervision of an Illinois
14 licensed physician in an Illinois patient care
15 clinic or facility that is affiliated with the
16 out-of-State post graduate training program; and
17 (e) that the temporary visiting resident
18 permit shall only permit the holder to practice
19 medicine in all of its branches or practice the
20 treatment of human ailments without the use of drugs
21 and without operative surgery within the scope of
22 the medical, osteopathic, chiropractic or clinical
23 studies for which the holder was invited or
24 appointed.
25 (2) The application for the temporary visiting
26 resident permit shall be made to the Department, in
27 writing, on forms prescribed by the Department, and shall
28 be accompanied by the required fee established by rule.
29 The application shall require information that, in the
30 judgment of the Department, will enable the Department to
31 pass on the qualifications of the applicant.
32 (3) A temporary visiting resident permit shall be
33 valid for 180 days from the date of issuance or until the
34 time the medical, osteopathic, chiropractic, or clinical

2 (4) The applicant for a temporary visiting resident
