1 AN ACT in relation to sex offenders.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Sex Offender and Child Murderer
5 Community Notification Law is amended by changing Section 115
6 as follows:

8 Sec. 115. Sex offender database.
9 (a) The Department of State Police shall establish and
10 maintain a Statewide Sex Offender Database for the purpose of
11 identifying sex offenders and making that information
12 available to the persons specified in Sections 120 and 125 of
13 this Law. The Database shall be created from the Law
14 Enforcement Agencies Data System (LEADS) established under
15 Section 6 of the Intergovernmental Missing Child Recovery Act
16 of 1984. The Department of State Police shall examine its
17 LEADS database for persons registered as sex offenders under
18 the Sex Offender Registration Act and shall identify those
19 who are sex offenders and shall add all the information,
20 including photographs if available, on those sex offenders to
21 the Statewide Sex Offender Database.
22 (a-5) The Department of State Police shall develop a
23 computer software program that would permit a law enforcement
24 officer who accesses the Statewide Sex Offender Database by
25 inputting the residence address of a sex offender to obtain a
26 map of a 5 mile radius from the sex offender's residence. The
27 map shall include every public and private school located
28 within that 5 mile radius. The Department of State Police
29 shall distribute the software program to every law
30 enforcement agency of this State.
31 (b) The Department of State Police must make the

1 information contained in the Statewide Sex Offender Database
2 accessible on the Internet by means of a hyperlink labeled
3 "Sex Offender Information" on the Department's World Wide Web
4 home page. The Department of State Police must update that
5 information as it deems necessary.
6 The Department of State Police may require that a person
7 who seeks access to the sex offender information submit
8 biographical information about himself or herself before
9 permitting access to the sex offender information. The
10 Department of State Police may limit access to the sex
11 offender information to information about sex offenders who
12 reside within a specified geographic area in proximity to the
13 address of the person seeking that information. The
14 Department of State Police must promulgate rules in
15 accordance with the Illinois Administrative Procedure Act to
16 implement this subsection (b) and those rules must include
17 procedures to ensure that the information in the database is
18 accurate.

20 Section 99. Effective date. This Act takes effect upon
21 becoming law.
