1 AN ACT concerning lakes.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Lake Management Program Act is
5 amended by changing Section 3 as follows:
6 (525 ILCS 25/3) (from Ch. 19, par. 1403)
7 Sec. 3. As used in this Act.
8 (a) "Administrative Framework Plan" means the plan
9 developed by the State to administer and implement the
10 requirements of this Act.
11 (b) "Agency" means the Illinois Environmental Protection
12 Agency.
13 (c) "Comprehensive lake management" means an action
14 resulting from lake management strategies and plans that
15 address all potential causes of lake degradation, including
16 factors situated both in the lake and within the lake's
17 tributary watershed; and followed by the development and
18 implementation of management strategies which impart long
19 term improvements and benefits for the lake.
20 (d) "Diagnostic and Feasibility Study" means the
21 gathering of data to document the existing and potential
22 sources of pollution and to determine the limnological,
23 morphological, demographic, and other pertinent
24 characteristics of an inland lake and its associated
25 watershed; and the analysis of this information to determine
26 the most appropriate method for improving or preserving the
27 quality of the lake and to determine the need for a Long Term
28 Restoration and Preservation Project or a Water Quality
29 Maintenance Program.
30 (e) "Lake" means any inland lake as recognized by the
31 Agency other than Lake Michigan, to which the public has

1 continuing and regular access.
2 (f) "Lake Owner" means the owner or owners of any inland
3 lake which possess the legal authority for a given lake to
4 perform Diagnostic and Feasibility Studies and to enact
5 comprehensive lake management through the implementation of
6 Long Term Restoration and Preservation Projects and Water
7 Quality Maintenance Programs.
8 (g) "Long Term Restoration and Preservation Project"
9 means an implementation of lake and watershed management
10 plans as developed under the Diagnostic and Feasibility Study
11 which will provide for long term restoration benefits and
12 long term preservation of the lake's water quality.
13 (h) "Monitoring" means programs to scientifically
14 document the existing quality of a lake and the potential
15 sources of pollutants which might lead to the lake's
16 degradation or reduced environmental and cultural values.
17 (i) "public education" means programs and instruments
18 designed to improve the general public's understanding of the
19 causes of lake management problems, alternatives for lake
20 restoration and protection, and the processes by which
21 comprehensive lake management strategies can be effectively
22 implemented.
23 (j) "Research" means programs and studies to
24 scientifically determine the effectiveness of lake
25 restoration and protection techniques, and to develop new and
26 more effective approaches for comprehensive lake management.
27 (k) "Technical assistance" means assistance by State
28 personnel trained in comprehensive lake management, and
29 provided to municipalities, soil and water conservation
30 districts, homeowners associations, lake managers, lake
31 homeowners, and other appropriate organizations and
32 individuals involved with lake management decision-making at
33 the local level; such assistance is likely to be provided to
34 a significant degree by on-site visits to affected lakes and

1 meetings with appropriate organizations and individuals.
2 (l) "Water Quality Maintenance Program" means an
3 implementation of a lake and watershed management program
4 recommended by the Diagnostic and Feasibility Study which
5 provides short-term relief from nuisance aquatic vegetation
6 and algae growth; projects under this program must
7 demonstrate that the proposed maintenance activities would
8 result in attainment of significant public recreational lake
9 use, and that watershed management plans are being
10 implemented to control and reduce incoming nutrients,
11 sediments, and other pollutants.
