1 AN ACT in relation to criminal law.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Code of Criminal Procedure of 1963 is
5 amended by adding Section 108-15 as follows:
6 (725 ILCS 5/108-15 new)
7 Sec. 108-15. Issuance of a Firearm Owner's
8 Identification Card not sole grounds for a search. A peace
9 officer may not search a person for the sole reason that the
10 person has been issued a Firearm Owner's Identification Card
11 by the Department of State Police. The issuance of a Firearm
12 Owner's Identification Card does not in and of itself
13 constitute probable cause to search a person and does not
14 constitute a reasonable suspicion that the peace officer or
15 another person is in danger of attack that would justify the
16 peace officer searching the person for weapons under Section
17 108-1.01.
18 Section 99. Effective date. This Act takes effect upon
19 becoming law.
