1 AN ACT concerning indemnification agreements.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Consumer Fraud and Deceptive Business
5 Practices Act is amended by adding Section 2MM as follows:
6 (815 ILCS 505/2MM new)
7 Sec. 2MM. Indemnification contracts; limitation. A
8 person may not in any contract or agreement of
9 indemnification require a party to the contract or agreement
10 to indemnify any other person for losses to the extent those
11 losses are not the fault of the party obligated to make the
12 indemnification. A person who violates this Section commits
13 an unlawful practice within the meaning of this Act.
14 Section 99. Effective date. This Act takes effect upon
15 becoming law.
