1 AN ACT in relation to airbag passive restraint systems.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Criminal Code of 1961 is amended by
5 adding Section 17-11.2 as follows:
6 (720 ILCS 5/17-11.2 new)
7 Sec. 17-11.2. Failure to restore a deployed or damaged
8 airbag passive restraint system.
9 (a) It is a violation of this Section for a body shop,
10 salvage rebuilder, vehicle service maintenance facility, or
11 other person to:
12 (1) knowingly fail to fully restore and repair to
13 all applicable federal safety regulations an airbag
14 passive restraint system that is deployed or damaged in a
15 motor vehicle accident or in any other manner;
16 (2) knowingly cause another person not to fully
17 restore and repair an airbag passive restraint system
18 that is deployed or damaged in a motor vehicle accident
19 or in any other manner; or
20 (3) knowingly install an airbag passive restraint
21 system which has been previously been installed in
22 another motor vehicle without disclosing in writing to
23 the owner or lessee of the vehicle receiving the airbag
24 passive restraint system installation that a used airbag
25 passive restraint system has been installed in the
26 repaired vehicle.
27 (b) A body shop, salvage rebuilder, vehicle service
28 maintenance facility, or other person must maintain a record
29 of airbag passive restraint system repairs for a period of
30 not less than 48 months.
31 (c) A violation of this Section is a business offense

1 punishable by a fine of not more than $5,000.
2 (d) A violation of this Section constitutes an unlawful
3 practice under the Consumer Fraud and Deceptive Business
4 Practices Act.
5 Section 10. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by changing Section 2Z as follows:
7 (815 ILCS 505/2Z) (from Ch. 121 1/2, par. 262Z)
8 Sec. 2Z. Violations of other Acts. Any person who
9 knowingly violates the Automotive Repair Act, the Home Repair
10 and Remodeling Act, the Dance Studio Act, the Physical
11 Fitness Services Act, the Hearing Instrument Consumer
12 Protection Act, the Illinois Union Label Act, the Job
13 Referral and Job Listing Services Consumer Protection Act,
14 the Travel Promotion Consumer Protection Act, the Credit
15 Services Organizations Act, the Automatic Telephone Dialers
16 Act, the Pay-Per-Call Services Consumer Protection Act, the
17 Telephone Solicitations Act, the Illinois Funeral or Burial
18 Funds Act, the Cemetery Care Act, the Safe and Hygienic Bed
19 Act, the Pre-Need Cemetery Sales Act, subsection (a) or (b)
20 of Section 3-10 of the Cigarette Tax Act, subsection (a) or
21 (b) of Section 3-10 of the Cigarette Use Tax Act, the
22 Electronic Mail Act, Section 17-11.2 of the Criminal Code of
23 1961, or paragraph (6) of subsection (k) of Section 6-305 of
24 the Illinois Vehicle Code commits an unlawful practice within
25 the meaning of this Act.
