1 AN ACT in relation to smoking.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Clean Indoor Air Act is amended
5 by changing Section 5 as follows:
6 (410 ILCS 80/5) (from Ch. 111 1/2, par. 8205)
7 Sec. 5. Smoking areas.
8 (a) The elected and appointed officials of the State of
9 Illinois and of any unit of local government and of any
10 school district, or their designee, having control over
11 property of the State or of a unit of local government or of
12 a school district which includes a public place, and the
13 proprietor of a structure which includes a public place may
14 establish an area on the premises as a smoking area where
15 smoking shall be permitted, unless otherwise prohibited by
16 law or ordinance. When establishing an area as a smoking
17 area, a person establishing such area shall utilize existing
18 physical barriers, ventilation systems, and other physical
19 elements of the premises to minimize the intrusion of smoke
20 into areas where smoking is not permitted. When a public
21 place is a single room or enclosure, a person establishing
22 such area may satisfy the purposes and provisions of this Act
23 by establishing a reasonable portion of the room or enclosure
24 as a smoking area.
25 (b) No person shall permit or require a minor under 18
26 years of age to enter an area designated as a "smoking area"
27 or to be in such proximity so that second-hand smoke can be
28 inhaled by a minor under 18 years of age.
