1 AN ACT in relation to vehicles.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by
5 changing Sections 6-106 and 6-110 as follows:
6 (625 ILCS 5/6-106) (from Ch. 95 1/2, par. 6-106)
7 Sec. 6-106. Application for license or instruction
8 permit.
9 (a) Every application for any permit or license
10 authorized to be issued under this Act must shall be made
11 upon a form furnished by the Secretary of State. Every
12 application shall be accompanied by the proper fee and
13 payment of such fee shall entitle the applicant to not more
14 than 3 attempts to pass the examination within a period of 1
15 year after the date of application.
16 (b) Every application shall state the name, social
17 security number, zip code, date of birth, sex, and residence
18 address of the applicant; briefly describe the applicant;
19 state whether the applicant has theretofore been licensed as
20 a driver, and, if so, when and by what state or country, and
21 whether any such license has ever been cancelled, suspended,
22 revoked or refused, and, if so, the date and reason for such
23 cancellation, suspension, revocation or refusal; shall
24 include an affirmation by the applicant that all information
25 set forth is true and correct; and shall bear the applicant's
26 signature. The application form may also require the
27 statement of such additional relevant information as the
28 Secretary of State shall deem necessary to determine the
29 applicant's competency and eligibility. The Secretary of
30 State may in his discretion substitute a federal tax number
31 in lieu of a social security number, or he may instead assign

1 an additional distinctive number in lieu thereof, where an
2 applicant is prohibited by bona fide religious convictions
3 from applying or is exempt from applying for a social
4 security number. The Secretary of State shall, however,
5 determine which religious orders or sects have such bona fide
6 religious convictions. The Secretary of State may, in his
7 discretion, by rule or regulation, provide that an
8 application for a drivers license or permit may include a
9 suitable photograph of the applicant in the form prescribed
10 by the Secretary, and he may further provide that each
11 drivers license shall include a photograph of the driver. The
12 Secretary of State may utilize a photograph process or system
13 most suitable to deter alteration or improper reproduction of
14 a drivers license and to prevent substitution of another
15 photo thereon.
16 (c) The application form shall include a notice to the
17 applicant of the registration obligations of sex offenders
18 under the Sex Offender Registration Act. The notice shall be
19 provided in a form and manner prescribed by the Secretary of
20 State. For purposes of this subsection (c), "sex offender"
21 has the meaning ascribed to it in Section 2 of the Sex
22 Offender Registration Act.
23 (d) Any male United States citizen or immigrant who
24 applies for any permit or license authorized to be issued
25 under this Act or for a renewal of any permit or license, and
26 who is at least 18 years of age but less than 26 years of
27 age, must be registered in compliance with the requirements
28 of the federal Military Selective Service Act. The Secretary
29 of State must forward in an electronic format the necessary
30 personal information regarding the applicants identified in
31 this subsection (d) to the Selective Service System. The
32 applicant's signature on the application serves as an
33 indication that the applicant either has already registered
34 with the Selective Service System or that he is authorizing

1 the Secretary to forward to the Selective Service System the
2 necessary information for registration. The Secretary must
3 notify the applicant at the time of application that his
4 signature constitutes consent to registration with the
5 Selective Service System, if he is not already registered.

8 Sec. 6-110. Licenses issued to drivers.
9 (a) The Secretary of State shall issue to every
10 qualifying applicant a driver's license as applied for, which
11 license shall bear a distinguishing number assigned to the
12 licensee, the name, social security number, zip code, date of
13 birth, address, and a brief description of the licensee, and
14 a space where the licensee may write his or her usual
15 signature.
16 If the licensee is less than 17 years of age, the license
17 shall, as a matter of law, be invalid for the operation of
18 any motor vehicle during any time the licensee is prohibited
19 from being on any street or highway under the provisions of
20 the Child Curfew Act.
21 Licenses issued shall also indicate the classification
22 and the restrictions under Section 6-104 of this Code.
23 In lieu of the social security number, the Secretary may
24 in his discretion substitute a federal tax number or other
25 distinctive number.
26 A driver's license issued may, in the discretion of the
27 Secretary, include a suitable photograph of a type prescribed
28 by the Secretary.
29 (b) The Secretary of State shall provide a format on the
30 reverse of each driver's license issued which the licensee
31 may use to execute a document of gift conforming to the
32 provisions of the Uniform Anatomical Gift Act. The format
33 shall allow the licensee to indicate the gift intended,

1 whether specific organs, any organ, or the entire body, and
2 shall accommodate the signatures of the donor and 2
3 witnesses. The Secretary shall also inform each applicant or
4 licensee of this format, describe the procedure for its
5 execution, and may offer the necessary witnesses; provided
6 that in so doing, the Secretary shall advise the applicant or
7 licensee that he or she is under no compulsion to execute a
8 document of gift. A brochure explaining this method of
9 executing an anatomical gift document shall be given to each
10 applicant or licensee. The brochure shall advise the
11 applicant or licensee that he or she is under no compulsion
12 to execute a document of gift, and that he or she may wish to
13 consult with family, friends or clergy before doing so. The
14 Secretary of State may undertake additional efforts,
15 including education and awareness activities, to promote
16 organ and tissue donation.
17 (c) The Secretary of State shall designate on each
18 driver's license issued a space where the licensee may place
19 a sticker or decal of the uniform size as the Secretary may
20 specify, which sticker or decal may indicate in appropriate
21 language that the owner of the license carries an Emergency
22 Medical Information Card.
23 The sticker may be provided by any person, hospital,
24 school, medical group, or association interested in assisting
25 in implementing the Emergency Medical Information Card, but
26 shall meet the specifications as the Secretary may by rule or
27 regulation require.
28 (d) The Secretary of State shall designate on each
29 driver's license issued a space where the licensee may
30 indicate his blood type and RH factor.
31 (e) The Secretary of State shall provide that each
32 original or renewal driver's license issued to a licensee
33 under 21 years of age shall be of a distinct nature from
34 those driver's licenses issued to individuals 21 years of age

1 and older. The color designated for driver's licenses for
2 licensees under 21 years of age shall be at the discretion of
3 the Secretary of State.
4 (f) The Secretary of State shall inform all Illinois
5 licensed commercial motor vehicle operators of the
6 requirements of the Uniform Commercial Driver License Act,
7 Article V of this Chapter, and shall make provisions to
8 insure that all drivers, seeking to obtain a commercial
9 driver's license, be afforded an opportunity prior to April
10 1, 1992, to obtain the license. The Secretary is authorized
11 to extend driver's license expiration dates, and assign
12 specific times, dates and locations where these commercial
13 driver's tests shall be conducted. Any applicant, regardless
14 of the current expiration date of the applicant's driver's
15 license, may be subject to any assignment by the Secretary.
16 Failure to comply with the Secretary's assignment may result
17 in the applicant's forfeiture of an opportunity to receive a
18 commercial driver's license prior to April 1, 1992.
19 (g) The Secretary of State shall designate on a driver's
20 license issued, a space where the licensee may indicate that
21 he or she has drafted a living will in accordance with the
22 Illinois Living Will Act or a durable power of attorney for
23 health care in accordance with the Illinois Power of Attorney
24 Act.
25 (g-1) The Secretary of State, in his or her discretion,
26 may designate on each driver's license issued a space where
27 the licensee may place a sticker or decal, issued by the
28 Secretary of State, of uniform size as the Secretary may
29 specify, that shall indicate in appropriate language that the
30 owner of the license has renewed his or her driver's license.
31 (h) A person who acts in good faith in accordance with
32 the terms of this Section is not liable for damages in any
33 civil action or subject to prosecution in any criminal
34 proceeding for his or her act.
