1 AN ACT in relation to the Metropolitan Water Reclamation
2 District.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Metropolitan Water Reclamation District
6 Act is amended by changing Section 4.32 as follows:
7 (70 ILCS 2605/4.32) (from Ch. 42, par. 323.32)
8 Sec. 4.32. Veteran's preference.
9 (a) A person who served on active duty in the United
10 States Army, Navy, Air Force, Marine Corps, or Coast Guard
11 for a period of more than 180 consecutive days and was
12 honorably discharged from that service is entitled to a
13 veteran's preference under this Section.
14 For the purpose of this Section, "active duty" does not
15 include training or inactive duty performed as a member of
16 the National Guard or a Reserve component of the armed
17 forces.
18 (b) The Director of Personnel shall give preference for
19 promotional appointment to a person qualifying for a
20 veteran's preference under this Section whose name appears on
21 a promotional eligible register by adding 5 points to the
22 final grade that the person receives as the result of any
23 promotional examination held on or after the effective date
24 of this amendatory Act of the 92nd General Assembly.
25 (c) The changes made to this Section by this amendatory
26 Act of the 92nd General Assembly are not intended to affect
27 any preference granted under this Section before the
28 effective date of this amendatory Act.
29 Persons who were engaged in the military or naval service
30 of the United States during the years 1898, 1899, 1900, 1901,
31 1902, 1914, 1915, 1916, 1917, 1918, or 1919, any time between

1 September 16, 1940 and July 25, 1947, or any time during the
2 national emergency between June 25, 1950 and January 31,
3 1955, and who were honorably discharged therefrom, and all
4 persons who were engaged in such military or naval service
5 during any of said years, any time between September 16, 1940
6 and July 25, 1947, or any time during the national emergency
7 between June 25, 1950 and January 31, 1955, or any time from
8 August 5, 1964 until the date determined by the Congress of
9 the United States as the end of Viet Nam hostilities, or at
10 any time between August 6, 1990 and the date the Persian Gulf
11 Conflict ends as prescribed by Presidential proclamation or
12 order, who are now or may hereafter be on inactive or reserve
13 duty in such military or naval service, not including,
14 however, persons who were convicted by court-martial of
15 disobedience of orders, where such disobedience consisted in
16 the refusal to perform military service on the ground of
17 alleged religious or conscientious objections against war,
18 shall be preferred for appointments to offices, positions and
19 places of employment in the classified service of the
20 District, provided they are found to possess the business
21 capacity necessary for the proper discharge of the duties of
22 such office, position, or place of employment as determined
23 by examination for original entrance. The Director of
24 Personnel on certifying from any existing register of
25 eligibles resulting from the holding of an examination for
26 original entrance or any register of eligibles that may be
27 hereafter created of persons who have taken and successfully
28 passed the examinations provided for in this Act for original
29 entrance commenced prior to September 1, 1949, shall place
30 the name or names of such persons at the head of any existing
31 eligible register or list of eligibles that shall be created
32 under the provisions of this Act to be certified for
33 appointment. The Director of Personnel shall give preference
34 for original appointment to persons as hereinabove designated

1 whose names appear on any register of eligibles resulting
2 from an examination for original entrance held under the
3 provisions of this Act and commenced on or after September 1,
4 1949 by adding to the final grade average which they received
5 or will receive as the result of any examination held for
6 original entrance, five points. The numerical result thus
7 attained shall be applied by the Director of Personnel in
8 determining the position of such persons on any eligible list
9 which has been created as the result of any examination for
10 original entrance commenced on or after September 1, 1949 for
11 purposes of preference in certification and appointment from
12 such eligible list.
13 Every certified Civil Service employee who was called to,
14 or who volunteered for, the military or naval service of the
15 United States at any time during the years specified in this
16 Act, or at any time between September 16, 1940 and July 25,
17 1947 or any time during the national emergency between June
18 25, 1950 and January 31, 1955, or any time from August 5,
19 1964 until the date determined by Congress of the United
20 States as the end of Viet Nam hostilities, or at any time
21 between August 6, 1990 and the date the Persian Gulf conflict
22 ends as prescribed by Presidential proclamation or order, and
23 who were honorably discharged therefrom or who are now or who
24 may hereafter be on inactive or reserve duty in such military
25 or naval service, not including, however, persons who were
26 convicted by court martial of disobedience of orders where
27 such disobedience consisted in the refusal to perform
28 military service on the ground of alleged religious or
29 conscientious objections against war, and whose names appear
30 on existing promotional eligible registers or any promotional
31 eligible register that may hereafter be created, as provided
32 for by this Act, shall be preferred for promotional
33 appointment to civil offices, positions and places of
34 employment in the classified civil service of the District

1 coming under the provisions of this Act.
2 The Director of Personnel shall give preference for
3 promotional appointment to persons as hereinabove designated
4 whose names appear on existing promotional eligible registers
5 or promotional eligible registers that may hereafter be
6 created by adding to the final grade average which they
7 received or will receive as the result of any promotional
8 examination commencing prior to September 1, 1949
9 three-fourths of one point for each 6 months or fraction
10 thereof of military or naval service not exceeding 48 months,
11 and by adding to the final grade average which they will
12 receive as the result of any promotional examination held
13 commencing on or after September 1, 1949 seven-tenths of one
14 point for each 6 months or fraction thereof of military or
15 naval service not exceeding 30 months. The numerical result
16 thus attained shall be applied by the Director of Personnel
17 in determining the position of such persons on any eligible
18 list which has been created or will be created as the result
19 of any promotional examination held hereunder for purposes of
20 preference in certification and appointment from such
21 eligible list.
22 No person shall receive the preference for a promotional
23 appointment granted by this Section after he has received one
24 promotion from an eligible list on which he was allowed such
25 preference and which was prepared as a result of an
26 examination held on or after September 1, 1949.
27 No person entitled to preference or credit for military
28 or naval service hereunder shall be required to furnish
29 evidence or record of honorable discharge from the armed
30 forces before any examination held under the provisions of
31 this Act but such preference shall be given after the posting
32 or publication of the eligible list or register and before
33 any certification or appointments are made from the eligible
34 register.

2 Section 99. Effective date. This Act takes effect on
