1 AMENDMENT TO SENATE BILL 1530
2 AMENDMENT NO. . Amend Senate Bill 1530 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Illinois Vehicle Code is amended by
5 changing Section 11-1301.3 as follows:
6 (625 ILCS 5/11-1301.3) (from Ch. 95 1/2, par. 11-1301.3)
7 Sec. 11-1301.3. Unauthorized use of parking places
8 reserved for persons with disabilities.
9 (a) It shall be prohibited to park any motor vehicle
10 which is not properly displaying bearing registration plates
11 or decals issued to a person with disabilities, as defined by
12 Section 1-159.1, pursuant to Sections 3-616, 11-1301.1 or
13 11-1301.2, or to a disabled veteran pursuant to Section 3-609
14 of this Act, as evidence that the vehicle is operated by or
15 for a person with disabilities or disabled veteran, in any
16 parking place, including any private or public offstreet
17 parking facility, specifically reserved, by the posting of an
18 official sign as designated under Section 11-301, for motor
19 vehicles displaying bearing such registration plates. It
20 shall be prohibited to park any motor vehicle in a designated
21 access aisle adjacent to any parking place specifically
22 reserved for persons with disabilities, by the posting of an

1 official sign as designated under Section 11-301, for motor
2 vehicles displaying bearing such registration plates. When
3 using the parking privileges for persons with disabilities,
4 the parking decal or device must be displayed properly in
5 the vehicle where it is clearly visible to law enforcement
6 personnel, either hanging from the rearview mirror or placed
7 on the dashboard of the vehicle in clear view. An individual
8 with a vehicle properly displaying bearing a person with
9 disabilities license plate or parking decal or device issued
10 to a disabled person under Sections 3-616, 11-1301.1, or
11 11-1301.2 is in violation of this Section if the person is
12 not the authorized holder of a person with disabilities
13 license plate or parking decal or device and is not
14 transporting the authorized holder of a person with
15 disabilities license plate or parking decal or device to or
16 from the parking location and the person uses the person with
17 disabilities license plate or parking decal or device to
18 exercise any privileges granted through the person with
19 disabilities license plates or parking decals or devices
20 under this Code. Any motor vehicle properly displaying
21 bearing a person with disabilities license plate or a person
22 with disabilities parking decal or device containing the
23 International symbol of access issued to persons with
24 disabilities by any local authority, state, district,
25 territory or foreign country shall be recognized by State and
26 local authorities as a valid license plate or device and
27 receive the same parking privileges as residents of this
28 State.
29 (b) Any person or local authority owning or operating
30 any public or private offstreet parking facility may, after
31 notifying the police or sheriff's department, remove or cause
32 to be removed to the nearest garage or other place of safety
33 any vehicle parked within a stall or space reserved for use
34 by a person with disabilities which does not display person

1 with disabilities registration plates or a special decal or
2 device as required under this Section.
3 (c) Any person found guilty of violating the provisions
4 of this Section shall be fined $100 in addition to any costs
5 or charges connected with the removal or storage of any motor
6 vehicle authorized under this Section; but municipalities by
7 ordinance may impose a fine up to $200 and shall display
8 signs indicating the fine imposed. If the amount of the fine
9 is subsequently changed, the municipality shall change the
10 sign to indicate the current amount of the fine. It shall not
11 be a defense to a charge under this Section that the sign
12 posted pursuant to this Section does not comply with the
13 technical requirements of Section 11-301, Department
14 regulations, or local ordinance if a reasonable person would
15 be made aware by the sign or notice on or near the parking
16 place that the place is reserved for a person with
17 disabilities.
18 (d) Local authorities shall impose fines as established
19 in subsection (c) for violations of this Section.
20 (e) As used in this Section, "authorized holder" means
21 an individual issued a person with disabilities license plate
22 under Section 3-616 of this Code or an individual issued a
23 person with disabilities parking decal or device under
24 Section 11-1301.2 of this Code.
