1 AMENDMENT TO SENATE BILL 1329
2 AMENDMENT NO. . Amend Senate Bill 1329, AS AMENDED,
3 immediately below Section 5, by inserting the following:
4 "Section 10. The Automated External Defibrillator Act is
5 amended by changing Sections 25 and 30 as follows:

7 Sec. 25. Illinois Department of Public Health;
8 responsibilities. The Illinois Department of Public Health
9 shall maintain incident reports on automated external
10 defibrillator use and conduct annual analyses of all related
11 data. The Department shall establish a central data base
12 regarding the location and uses of automated external
13 defibrillators in Illinois, if known from incident reports,
14 specific data collection undertaken by the Department, or
15 other available sources of information. The Department shall
16 adopt rules to carry out its responsibilities under this Act.
17 The Director of Public Health shall establish guidelines
18 with respect to placing automated external defibrillators in
19 State buildings. The guidelines shall take into account the
20 extent to which the devices may be used by lay persons, the
21 typical number of employees and visitors in the buildings,
22 the extent of the need for security measures regarding the

1 buildings, buildings or portions of buildings in which there
2 are special circumstances such as high electrical voltage or
3 extreme heat or cold, and other factors that the Director
4 determines are appropriate. The Director shall recommend the
5 appropriate placement of the automated external
6 defibrillators in State buildings on the basis of the
7 guidelines. The recommendations shall at least include, when
8 appropriate, placement in State buildings in which more than
9 200 persons may be present at any particular time.
10 The Director of Public Health shall establish guidelines
11 with respect to placing automated external defibrillators in
12 all public and private school buildings and other school
13 facilities, including appropriate placements and the training
14 of personnel for use of automated external defibrillators at
15 school-sponsored athletic activities and events. By March
16 1, 2002, the Director shall recommend a program of assistance
17 and training to enable schools' compliance with the
18 guidelines.

21 Sec. 30. Exemption from civil liability.
22 (a) A physician licensed in Illinois to practice
23 medicine in all its branches who authorizes the purchase of
24 an automated external defibrillator is not liable for civil
25 damages as a result of any act or omission arising out of
26 authorizing the purchase of an automated external
27 defibrillator, except for willful or wanton misconduct, if
28 the requirements of this Act are met.
29 (b) An individual or entity providing training in the
30 use of automated external defibrillators is not liable for
31 civil damages as a result of any act or omission involving
32 the use of an automated external defibrillator, except for
33 willful or wanton misconduct, if the requirements of this Act

1 are met.
2 (c) A person owning, occupying, or managing the premises
3 where an automated external defibrillator is located or to
4 which an automated external defibrillator has been moved for
5 use is not liable for civil damages as a result of any act or
6 omission involving the use of an automated external
7 defibrillator, except for willful or wanton misconduct, if
8 the requirements of this Act are met.
9 (d) A trained AED user is not liable for civil damages
10 as a result of any act or omission involving the use of an
11 automated external defibrillator in an emergency situation,
12 except for willful or wanton misconduct, if the requirements
13 of this Act are met.
