1 AN ACT concerning townships.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Township Code is amended by changing
5 Sections 45-10 and 45-55 as follows:
6 (60 ILCS 1/45-10)
7 Sec. 45-10. Political party caucus in township; notice.
8 (a) On the second Tuesday in January preceding the date
9 of the regular township election, a caucus shall be held by
10 the voters of each established political party in a township
11 to nominate its candidates for the various offices to be
12 filled at the election. Notice of the caucus shall be given
13 at least 10 days before it is held by publication in some
14 newspaper having a general circulation in the township. Not
15 less than 30 days before the caucus, the township clerk shall
16 notify the chairman or membership of each township central
17 committee by first-class mail of the chairman's or
18 membership's obligation to report the time and location of
19 the political party's caucus. Not less than 20 days before
20 the caucus, each chairman of the township central committee
21 shall notify the township clerk by first-class mail of the
22 time and location of the political party's caucus. If the
23 time and location of 2 or more political party caucuses
24 conflict, the township clerk shall establish, by a fair and
25 impartial public lottery, the time and location for each
26 caucus.
27 (b) Except as provided in this Section, the township
28 board shall cause notices of the caucuses to be published.
29 The notice shall state the time and place where the caucus
30 for each political party will be held. The board shall fix a
31 place within the township for holding the caucus for each

1 established political party. When a new township has been
2 established under Section 10-25, the county board shall cause
3 notice of the caucuses to be published as required by this
4 Section and shall fix the place within the new township for
5 holding the caucuses.
6 (c) Notwithstanding any other provision of law, a caucus
7 may not be held if the township central committee has filed a
8 statement of determination with the county clerk or board of
9 election commissioners, as the case may be, under Section
10 45-55 of this Code.

13 Sec. 45-55. Nomination by primary election. In (i)
14 counties having a population of more than 3,000,000, the
15 township central committee of a political party composed of
16 the elected township committeeman and his or her appointed
17 precinct committeemen and (ii) townships with a population of
18 more than 15,000 in counties with a population of 3,000,000
19 or less, the township central committee of a political party
20 composed of the precinct committeemen may, with respect to
21 any regular township election, determine that its candidates
22 for township offices shall be nominated by primary in
23 accordance with the general election law, rather than in the
24 manner provided in Sections 45-5 through 45-45. If the
25 township central committee makes that determination, it must
26 file a statement of the determination with the county clerk
27 and the township clerk no later than November 15 preceding
28 the township election. If the township or any part of the
29 township is within the jurisdiction of a board of election
30 commissioners, the township central committee shall promptly
31 notify the board of election commissioners of the
32 determination. Within 10 days after receiving the statement
33 of determination, the township clerk must publish, in a

1 newspaper having general circulation within the township, a
2 notice stating that the township central committee has chosen
3 to hold a primary election to nominate candidates for
4 township office instead of holding a township caucus. Upon
5 the filing of the determination by the township central
6 committee of a political party, the provisions of the general
7 election law shall govern the nomination of candidates of
8 that political party for township offices for the election
9 with respect to which the determination was made.
