1 AN ACT concerning real estate.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Savanna Army Depot Retrocession Law.
6 Section 5. Authorization to accept retrocession.
7 (a) Under the provisions of Section 2683 of Title 10 of
8 the United States Code, the State of Illinois authorizes
9 acceptance of retrocession by the United States of America of
10 concurrent legislative jurisdiction over lands consisting of
11 the U.S. Army Depot Activity Savanna Military Reservation, Jo
12 Daviess County and Carroll County, Illinois, being more
13 particularly described as follows:
14 Situate in the State of Illinois, Jo Daviess County and
15 Carroll County, in sections 1, 2, 3, 4, 5, 10, 11, and 12
16 of Township 25 north, Range 2 east and sections 18, 19,
17 20, 28, 29, 30, 31, 32, 33, and 34 of Township 26 north,
18 Range 2 east and Sections 3, 4, 5, 8, 9, 10, 11, 12, 13,
19 14, 15, 16, 21, 22, 23, 24, 25, 26, 27, 35, and 36 of
20 Township 26 north, Range 1 east, and section 6 of
21 Township 25 north, Range 3 east, all of the Fourth
22 Principal Meridian, and more particularly described as
23 follows.
24 Beginning at a concrete monument at the intersection of
25 the east bank of the Mississippi River and the north line
26 of section 5, Township 26 north, Range 1 east; thence
27 with said north line
28 Easterly 3,141 feet to a buggy axle at the northeast
29 corner of section 5; thence with the north line of
30 section 4

9 Further, the State of Illinois accepts retrocession of
10 and authorizes acceptance of retrocession of concurrent
11 legislative jurisdiction over all those lands owned by the
12 United States that may subsequently be identified by the
13 Department of the Army as part of the U.S. Army Depot
14 Activity Savanna Military Reservation, Jo Davies County and
15 Carroll County, Illinois, although not included within the
16 legal description contained in this subsection, to the extent
17 concurrent jurisdiction has not previously been retroceded to
18 the State of Illinois. Any additional land over which the
19 State accepts retrocession of concurrent jurisdiction shall
20 be identified in a notice filed by the Governor as provided
21 in subsection (d).
22 (b) Pursuant to concurrent legislative jurisdiction, both
23 State and federal laws are applicable. Since most major
24 crimes violate both federal and State laws, both may punish
25 an offender for an offense committed in the area. The State
26 of Illinois, subject to the exemption of the federal
27 government, has the right to tax. The regulatory powers of
28 the State of Illinois may be exercised in the area, but not
29 in such a manner as to interfere with federal functions.
30 Persons residing on the area under concurrent legislative
31 jurisdiction are ensured important rights and privileges of
32 citizenship, such as the right to vote and access to the
33 Illinois courts.
34 (c) Subject to subsection (b), the State of Illinois

1 accepts cession of concurrent legislative jurisdiction from
2 the United States.
3 (d) The Governor of the State of Illinois is authorized
4 to accept the retrocession of concurrent legislative
5 jurisdiction over the subject lands by filing a notice of
6 acceptance with the Illinois Secretary of State.
7 (e) Upon transfer by deed of the subject lands, or any
8 portion thereof, by the United States of America, the
9 concurrent jurisdiction retained by the United States shall
10 expire as to the particular property transferred.
11 Section 99. Effective date. This Act takes effect upon
12 becoming law.
