1 AN ACT in relation to public employee benefits.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Pension Code is amended by
5 changing Section 8-230.1 as follows:
6 (40 ILCS 5/8-230.1) (from Ch. 108 1/2, par. 8-230.1)
7 Sec. 8-230.1. Right of employees to contribute for
8 certain other service. Any employee in the service, after
9 having made contributions covering a period of 10 or more
10 years to the annuity and benefit fund herein provided for,
11 may elect to pay for and receive credit for all annuity
12 purposes for service theretofore rendered by the employee to
13 the Chicago Transit Authority created by the Metropolitan
14 Transit Authority Act or its predecessor public utilities;
15 provided that the last 5 years of service prior to retirement
16 on annuity shall have been as an employee of the City and a
17 contributor to this Fund. Such service credit may be paid
18 for and granted on the same basis and conditions as are
19 applicable in the case of employees who make payment for past
20 service under the provisions of Section 8-230, but on the
21 assumption that the employee's salary throughout all of his
22 or her service with the Authority or its predecessor public
23 utilities was at the rate of the employee's salary at the
24 date of his or her entrance into the service as a municipal
25 employee. In no event, however, shall such service be
26 credited if the employee has not forfeited and relinquished
27 pension credit for service covering such period under any
28 pension or retirement plan applicable to the Authority or its
29 predecessor public utilities and instituted and maintained by
30 the Authority or its predecessor public utilities for the
31 benefit of its employees.

1 If the application to establish credit under this Section
2 is received by the Fund on or after the effective date of
3 this amendatory Act of the 92nd General Assembly and before
4 July 1, 2002, no contribution from the employee is required
5 to establish credit for service rendered by the employee to
6 the Chicago Transit Authority during the period July 1, 1974
7 through August 31, 1978. This amendatory Act does not
8 entitle any person to a refund of contributions already paid
9 for credit previously established under this Section.

11 Section 90. The State Mandates Act is amended by adding
12 Section 8.25 as follows:
13 (30 ILCS 805/8.25 new)
14 Sec. 8.25. Exempt mandate. Notwithstanding Sections 6
15 and 8 of this Act, no reimbursement by the State is required
16 for the implementation of any mandate created by this
17 amendatory Act of the 92nd General Assembly.
18 Section 99. Effective date. This Act takes effect upon
19 becoming law.
