1 AN ACT concerning beekeeping.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Bees and Apiaries Act is amended by
5 changing Section 2-1 as follows:
6 (510 ILCS 20/2-1)
7 Sec. 2-1. Nuisances. All bees, colonies, or items of bee
8 equipment, where bee diseases, bee parasites or exotic
9 strains of bees exist; or hives that cannot be readily
10 inspected; or colonies that are not registered, are declared
11 to be nuisances to be regulated as prescribed by the
12 Department.
13 If the Department finds by inspection that any person is
14 maintaining a nuisance as described in this Section, it must
15 shall proceed to regulate the nuisance by methods or
16 procedures deemed necessary for control in accordance with
17 rules and regulations of the Department.
18 If the owner or beekeeper cannot be found or will not
19 consent to the terms for regulation of the nuisance, the
20 Department shall notify in writing the owner or beekeeper,
21 disclose the fact that nuisance exits and prescribe the
22 method by which the nuisance may be abated. The notice
23 declaring that a nuisance exists and ordering its abatement
24 must shall include:
25 (1) a statement of conditions constituting the
26 nuisance;
27 (2) establishment of the time period within which
28 the nuisance is to be abated;
29 (3) directions, written or printed, pointing out
30 the methods that shall be employed to abate the nuisance;
31 (4) a statement of the consequences should the

1 owner or beekeeper fail to comply.
2 The notice may be served personally or by certified mail
3 with a return receipt requested. The directions for
4 abatement of a nuisance may consist of a printed circular,
5 bulletin or report of the Department, the United States
6 Department of Agriculture or others, or an extract from such
7 document.
8 If the person so notified refuses or fails to abate the
9 nuisance in the manner and in the time prescribed in the
10 notice, the Department may cause the nuisance to be abated.
11 The Department must shall certify, to the owner or beekeeper,
12 the cost of the abatement. The owner or beekeeper must shall
13 pay to the Department any costs of that action, within 60
14 days after certification that the nuisance has been abated.
15 If the costs of abatement are not remitted, the Department
16 may recover the costs before any court in the State having
17 competent jurisdiction.
