1 AMENDMENT TO SENATE BILL 885
2 AMENDMENT NO. . Amend Senate Bill 885 on page 1 by
3 inserting immediately below line 3 the following:
4 "Section 2. The School Code is amended by adding
5 Sections 2-3.131, 3-14.29, 10-28, 22-27, and 34-18.22 and
6 changing Section 3-14 as follows:
7 (105 ILCS 5/2-3.131 new)
8 Sec. 2-3.131. Sharing information on school lunch
9 applicants. The State Board of Education shall, whenever
10 requested by the Department of Public Aid, agree in writing
11 with the Department of Public Aid (as the State agency that
12 administers the State Medical Assistance Program as provided
13 in Title XIX of the federal Social Security Act and the State
14 Children's Health Insurance Program as provided in Title XXI
15 of the federal Social Security Act) to share with the
16 Department of Public Aid information on applicants for free
17 or reduced-price lunches. This sharing of information shall
18 be for the sole purpose of helping the Department of Public
19 Aid identify and enroll children in the State Medical
20 Assistance Program or the State Children's Health Insurance
21 Program or both as allowed under 42 U.S.C.
22 1758(b)(2)(C)(iii)(IV) and under the restrictions set forth

1 in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii).

3 Sec. 3-14. Duties of regional superintendent. The
4 regional superintendent of schools shall perform the duties
5 enumerated in the following Sections preceding Section 3-15
6 3-14.1 through 3-14.25.

9 Sec. 3-14.29. Sharing information on school lunch
10 applicants. Whenever requested by the Department of Public
11 Aid, to agree in writing with the Department of Public Aid
12 (as the State agency that administers the State Medical
13 Assistance Program as provided in Title XIX of the federal
14 Social Security Act and the State Children's Health Insurance
15 Program as provided in Title XXI of the federal Social
16 Security Act) to share with the Department of Public Aid
17 information on applicants for free or reduced-price lunches.
18 This sharing of information shall be for the sole purpose of
19 helping the Department of Public Aid identify and enroll
20 children in the State Medical Assistance Program or the State
21 Children's Health Insurance Program or both as allowed under
22 42 U.S.C. 1758(b)(2)(C)(iii)(IV) and under the restrictions
23 set forth in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii).

25 Sec. 10-28. Sharing information on school lunch
26 applicants. A school board shall, whenever requested by the
27 Department of Public Aid, agree in writing with the
28 Department of Public Aid (as the State agency that
29 administers the State Medical Assistance Program as provided
30 in Title XIX of the federal Social Security Act and the State
31 Children's Health Insurance Program as provided in Title XXI

1 of the federal Social Security Act) to share with the
2 Department of Public Aid information on applicants for free
3 or reduced-price lunches. A school board shall, whenever
4 requested by the Department of Public Aid, require each of
5 its schools to agree in writing with the Department of Public
6 Aid to share with the Department of Public Aid information on
7 applicants for free or reduced-price lunches. This sharing of
8 information shall be for the sole purpose of helping the
9 Department of Public Aid identify and enroll children in the
10 State Medical Assistance Program or the State Children's
11 Health Insurance Program or both as allowed under 42 U.S.C.
12 1758(b)(2)(C)(iii)(IV) and under the restrictions set forth
13 in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii).

15 Sec. 22-27. Sharing information on school lunch
16 applicants; consent. Before an entity shares with the
17 Department of Public Aid information on an applicant for free
18 or reduced-price lunches under Section 2-3.131, 3-14.29,
19 10-28, or 34-18.22 of this Code or Section 10 of the School
20 Breakfast and Lunch Program Act, that entity must obtain, in
21 writing, the consent of the applicant's parent or legal
22 guardian.

24 Sec. 34-18.22. Sharing information on school lunch
25 applicants. The board shall, whenever requested by the
26 Department of Public Aid, agree in writing with the
27 Department of Public Aid (as the State agency that
28 administers the State Medical Assistance Program as provided
29 in Title XIX of the federal Social Security Act and the State
30 Children's Health Insurance Program as provided in Title XXI
31 of the federal Social Security Act) to share with the
32 Department of Public Aid information on applicants for free

1 or reduced-price lunches. The board shall, whenever
2 requested by the Department of Public Aid, require each of

12 Section 3. The School Breakfast and Lunch Program Act is
13 amended by adding Section 10 as follows:

15 Sec. 10. Sharing information on school lunch applicants.
16 Each private school that receives funds for free or
17 reduced-price lunches under this Act shall, whenever
18 requested by the Department of Public Aid, agree in writing
19 with the Department of Public Aid (as the State agency that
20 administers the State Medical Assistance Program as provided
21 in Title XIX of the federal Social Security Act and the State
22 Children's Health Insurance Program as provided in Title XXI
23 of the federal Social Security Act) to share with the
24 Department of Public Aid information on applicants for free
25 or reduced-price lunches. This sharing of information shall
26 be for the sole purpose of helping the Department of Public
27 Aid identify and enroll children in the State Medical
28 Assistance Program or the State Children's Health Insurance
29 Program or both as allowed under 42 U.S.C.
30 1758(b)(2)(C)(iii)(IV) and under the restrictions set forth
31 in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii).".
