1 AN ACT in relation to transportation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by
5 changing Section 11-1420 as follows:
6 (625 ILCS 5/11-1420) (from Ch. 95 1/2, par. 11-1420)
7 Sec. 11-1420. Funeral processions.
8 (a) A funeral procession processions has have the
9 right-of-way at intersections when vehicles comprising the
10 such procession have their headlights lighted, subject to
11 the following conditions and exceptions:
12 1. Operators of vehicles in a funeral procession
13 shall yield the right-of-way upon the approach of an
14 authorized emergency vehicle giving an audible or visible
15 signal;
16 2. Operators of vehicles in a funeral procession
17 shall yield the right-of-way when directed to do so by a
18 traffic officer;
19 3. The operator of the leading vehicle in a funeral
20 procession shall comply with stop signs and traffic
21 control signals but when the leading vehicle has
22 proceeded across an intersection in accordance with such
23 signal or after stopping as required by the stop sign,
24 all vehicles in such procession may proceed without
25 stopping, regardless of the sign or signal and the
26 leading vehicle and the vehicles in procession shall
27 proceed with due caution.
28 (b) The operator of a vehicle not in the funeral
29 procession shall not drive his vehicle in the funeral
30 procession except when authorized to do so by a traffic
31 officer or when such vehicle is an authorized emergency

1 vehicle giving audible or visible signal.
2 (c) Operators of vehicles not a part of a funeral
3 procession may not form a procession or convoy and have their
4 headlights lighted for the purpose of securing the
5 right-of-way granted by this Section to funeral processions.
6 (d) The operator of a vehicle not in a funeral
7 procession may overtake and pass the vehicles in such
8 procession if such overtaking and passing can be accomplished
9 without causing a traffic hazard or interfering with such
10 procession.
11 (e) The lead vehicle in the funeral procession may be
12 equipped with a flashing amber light which may be used only
13 when such vehicle is used as a lead vehicle in such
14 procession. Vehicles comprising a funeral procession may
15 utilize funeral pennants or flags or windshield stickers or
16 flashing hazard warning signal flashers to identify the
17 individual vehicles in such a procession.
