1 AN ACT concerning public aid.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5 changing Section 1-10 as follows:
6 (305 ILCS 5/1-10)
7 Sec. 1-10. Drug convictions.
8 (a) Persons convicted of an offense under the Illinois
9 Controlled Substances Act or the Cannabis Control Act which
10 is a Class X felony, or a Class 1 felony, or comparable
11 federal criminal law which has as an element the possession,
12 use, or distribution of a controlled substance, as defined in
13 Section 102(6) of the federal Controlled Substances Act (21
14 U.S.C. 802(c)), shall not be eligible for cash assistance
15 provided under this Code.
16 (b) A person Persons convicted of any other felony under
17 the Illinois Controlled Substances Act or the Cannabis
18 Control Act which is not a Class X or Class 1 felony, or
19 comparable federal criminal law which has as an element the
20 possession, use, or distribution of a controlled substance,
21 as defined in Section 102(6) of the federal Controlled
22 Substances Act (21 U.S.C. 802(c)), may, if he or she is
23 otherwise shall not be eligible for cash assistance provided
24 under this Code, receive cash assistance for a maximum of 3
25 months in his or her lifetime after for 2 years from the date
26 of his or her conviction. This limitation prohibition shall
27 not apply if the person is in a drug treatment program,
28 aftercare program, or similar program as defined by rule.
29 (c) Persons shall not be determined ineligible for food
30 stamps provided under this Code based upon a conviction of
31 any felony or comparable federal or State criminal law which

1 has an element the possession, use or distribution of a
2 controlled substance, as defined in Section 102(6) of the
3 federal Controlled Substance Act (21 U.S.C. 802(c)).
