 1                    AMENDMENT TO SENATE BILL 265

 2        AMENDMENT NO.     .  Amend Senate Bill 265 as follows:

 3    on page 1, by inserting after line 18 the following:

 4        "Section 10.  The Illinois Controlled Substances  Act  is
 5    amended by adding  Section 407.3 as follows:

 6        (720 ILCS 570/ 407.3 new)
 7        Sec.   407.3.   Presence  of  a  person  under  18 during
 8    illegal delivery of controlled, counterfeit,  or   look-alike
 9    substance.   A  person  18  years of age or over who violates
10    Section 401, 404, or 405 of  this  Act  and  who  during  the
11    commission  of the offense knowingly causes a person under 18
12    years of age to witness the  commission  of  the  offense  is
13    guilty of a Class 1 felony.".
