1 HOUSE JOINT RESOLUTION
2 CONSTITUTIONAL AMENDMENT
3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
4 NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
5 SENATE CONCURRING HEREIN, that there shall be submitted to
6 the electors of the State for adoption or rejection at the
7 general election next occurring at least 6 months after the
8 adoption of this resolution a proposition to amend Section 2
9 of Article X of the Constitution as follows:

11 EDUCATION

13 SECTION 2. STATE BOARD OF EDUCATION - STATE SUPERINTENDENT OF
14 EDUCATION CHIEF STATE EDUCATIONAL OFFICER
15 (a) There is created a State Board of Education to be
16 elected or selected on a regional basis. The number of
17 members, their qualifications, terms of office and manner of
18 election or selection shall be provided by law. The Board
19 shall advise the State Superintendent of Education
20 concerning, except as limited by law, may establish goals,
21 determine policies, provide for planning and evaluating
22 education programs, and recommend financing. The Board shall
23 have such other duties and powers as provided by law.
24 (b) A State Superintendent of Education shall be
25 nominated at a general primary election and elected by the
26 electors of the State at the general election every 4 years,
27 beginning in 2006. The State Superintendent of Education
28 shall hold office for 4 years beginning on the second Monday
29 of January after his or her election. To be eligible to hold
30 the office of State Superintendent of Education a person must
31 be a United States citizen, at least 25 years old, and a
32 resident of the State for 10 years preceding his or her

1 election.
2 The names of the candidates for State Superintendent of
3 Education shall be printed on the ballot directly below the
4 names of the candidates for Secretary of State.
5 Any vacancy in the office of State Superintendent of
6 Education shall be filled in the manner provided in Section 7
7 of Article V.
8 The State Superintendent of Education shall be the chief
9 educational officer of the State. The State Superintendent
10 of Education shall establish goals, determine policies,
11 provide for planning and evaluating education programs, and
12 recommend financing. The State Superintendent of Education
13 shall have such other duties and powers as provided by law.
14 The State Board of Education shall appoint a chief state
15 educational officer.

17 SCHEDULE
18 A State Superintendent of Education shall be elected in
19 2006 and thereafter. When the State Superintendent of
20 Education initially elected under Section 2 of Article X of
21 the Illinois Constitution takes office, the term of office of
22 the chief state educational officer appointed by the State
23 Board of Education shall expire. This Constitutional
24 Amendment otherwise takes effect when the State
25 Superintendent of Education initially elected under Section 2
26 of Article X of the Illinois Constitution takes office.
