1 AN ACT in relation to health facilities.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Nursing Home Care Act is amended by
5 changing Section 2-203 and adding Section 2-203.5 as follows:
6 (210 ILCS 45/2-203) (from Ch. 111 1/2, par. 4152-203)
7 Sec. 2-203. Each facility shall establish a residents'
8 advisory council. The administrator shall designate a member
9 of the facility staff to coordinate the establishment of, and
10 render assistance to, the council.
11 (a) The composition of the residents' advisory council
12 shall be composed of 5 resident members elected by the
13 residents of the facility. If there are not 5 residents
14 capable of functioning on the council, residents'
15 representatives may serve in the place of the necessary
16 number of residents. specified by Department regulation, but
17 No employee or affiliate of a facility shall be a member of
18 any council, but such employees or affiliates may attend a
19 council meeting to discuss interests or functions of
20 non-members when invited to do so by a majority of the
21 council.
22 (a-5) A facility having 200 or more beds may establish
23 additional residents' advisory councils for various smaller
24 units within the facility. If a facility establishes such an
25 additional council for a unit within the facility, the
26 facility must ensure that the unit is still represented on
27 the facility residents' advisory council serving the entire
28 facility.
29 (b) The council shall meet at least once each month with
30 the staff coordinator who shall provide assistance to the
31 council in preparing and disseminating a report of each

1 meeting to all residents, the administrator, and the staff.
2 All council meetings must be open to participation by all
3 residents of the facility (or by all residents of a smaller
4 unit within the facility in the case of a council established
5 for that unit under paragraph (a-5)) and by members of the
6 residents' families.
7 (c) Records of the council meetings will be maintained
8 in the office of the administrator.
9 (d) The residents' advisory council may communicate to
10 the administrator the opinions and concerns of the residents.
11 The council shall review procedures for implementing resident
12 rights, facility responsibilities and make recommendations
13 for changes or additions which will strengthen the facility's
14 policies and procedures as they affect residents' rights and
15 facility responsibilities.
16 (e) The council shall do the following: be a forum for:
17 (1) Obtain Obtaining and disseminate disseminating
18 information.;
19 (2) Solicit Soliciting and adopt adopting
20 recommendations for facility programing and
21 improvements.;
22 (3) Promptly identify problems Early identification
23 and make recommendations for the for recommending orderly
24 resolution of those problems.
25 (f) The council may present complaints as provided in
26 Section 3-702 on behalf of a resident to the Department, the
27 Long-Term Care Facility Advisory Board created by Section
28 2-204, or to any other person it considers appropriate.

31 Sec. 2-203.5. Community liaisons. Each facility must
32 develop and implement a plan for ensuring liaison with
33 concerned individuals and groups in the local community in

1 which the facility is located. The plan may include, but need
2 not be limited to, the following features:
3 (1) Establishing a separate community advisory
4 group composed of persons chosen by the residents of the
5 facility.
6 (2) Establishing a relationship with a church or
7 civic group, in which the church or civic group provides
8 appropriate social or other services for the residents of
9 the facility.
10 (3) Establishing a family council composed of
11 family members and friends of residents who live in the
12 community.
