1 AMENDMENT TO HOUSE BILL 6004
2 AMENDMENT NO. . Amend House Bill 6004 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The State Finance Act is amended by adding
5 Section 5.570 as follows:
6 (30 ILCS 105/5.570 new)
7 Sec. 5.570. The Illinois Pan Hellenic Trust Fund.
8 Section 10. The Illinois Vehicle Code is amended by
9 adding Section 3-654 as follows:
10 (625 ILCS 5/3-654 new)
11 Sec. 3-654. Pan Hellenic license plates.
12 (a) The Secretary, upon receipt of all applicable fees
13 and applications made in the form prescribed by the
14 Secretary, may issue special registration plates designated
15 as Pan Hellenic license plates. The special plates issued
16 under this Section shall be affixed only to passenger
17 vehicles of the first division or motor vehicles of the
18 second division weighing not more than 8,000 pounds. Plates
19 issued under this Section shall expire according to the
20 multi-year procedure established by Section 3-414.1 of this

1 Code.
2 (b) The design and color of the special plates shall be
3 wholly within the discretion of the Secretary, except that an
4 emblem of a Pan Hellenic eligible member shall be on the
5 plate. Appropriate documentation, as determined by the
6 Secretary, shall accompany each application. The Secretary
7 may, in his or her discretion, allow the plates to be issued
8 as vanity or personalized plates in accordance with Section
9 3-405.1 of this Code. The plates are not required to
10 designate "Land of Lincoln" as prescribed in subsection (b)
11 of Section 3-412 of this Code. The Secretary, in his or her
12 discretion, may prescribe rules governing the requirements
13 and approval of the special plates.
14 (c) An applicant for the special plate shall be charged
15 a $40 fee for original issuance in addition to the
16 appropriate registration fee. Of this fee, $25 shall be
17 deposited into the Illinois Pan Hellenic Trust Fund and $15
18 shall be deposited into the Secretary of State Special
19 License Plate Fund, to be used by the Secretary to help
20 defray the administrative processing costs. For each
21 registration renewal period, a $27 fee, in addition to the
22 appropriate registration fee, shall be charged. Of this fee,
23 $25 shall be deposited into the Illinois Pan Hellenic Trust
24 Fund and $2 shall be deposited into the Secretary of State
25 Special License Plate Fund.
26 (d) The Illinois Pan Hellenic Trust Fund is created as a
27 special fund in the State Treasury. The State Treasurer shall
28 create separate accounts within the Illinois Pan Hellenic
29 Trust Fund for each eligible member for which Pan Hellenic
30 license plates have been issued. Moneys in the Illinois Pan
31 Hellenic Trust Fund shall be allocated to each account in
32 proportion to the number of plates sold in regard to each
33 fraternity or sorority. All moneys in the Illinois Pan
34 Hellenic Trust Fund shall be distributed, subject to

1 appropriation by the General Assembly and approval by the
2 Secretary, as grants to the Illinois Alpha Kappa Alpha
3 Charitable Foundation, Illinois Delta Sigma Theta Charitable
4 Foundation, Illinois Zeta Phi Beta Charitable Foundation,
5 Illinois Sigma Gamma Rho Charitable Foundation, Illinois
6 Alpha Phi Alpha Charitable Foundation, Illinois Omega Psi Phi
7 Charitable Foundation, Illinois Kappa Alpha Psi Charitable
8 Foundation, Illinois Phi Beta Sigma Charitable Foundation, or
9 Illinois Iota Phi Theta Charitable Foundation for charitable
10 purposes sponsored by the African-American fraternity or
11 sorority.
