1 AN ACT concerning the Illinois Century Network.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Century Network Act is amended
5 by changing Sections 10, 15, and 20 as follows:

7 Sec. 10. Illinois Century Network. The Illinois Century
8 Network shall be a service creating and maintaining high
9 speed telecommunications networks network that provide
10 provides reliable communication links to and among Illinois
11 schools, institutions of higher education, libraries,
12 museums, research institutions, State agencies, units of
13 local government, and other local entities that provide
14 services to Illinois citizens. The Illinois Century Network
15 shall build on existing investments in networking schools,
16 colleges, and universities, avoid duplication of future
17 efforts, maintain sufficient capacity to meet the
18 requirements of the participating institutions, and stay
19 current with rapid developments in technology. The Illinois
20 Century Network shall be capable of delivering
21 state-of-the-art access to education, training, and
22 electronic information and shall provide access to networking
23 technologies for institutions located in even the most remote
24 areas of this State.

27 Sec. 15. Management of the Illinois Century Network.
28 (a) Staffing and contractual services necessary to
29 support the network's activities shall be governed by the
30 Illinois Century Network Policy Committee. The committee

1 shall include:
2 (1) 6 standing members as follows:
3 (i) the Illinois State Library Director or
4 designee;
5 (ii) the Illinois State Museum Director or
6 designee;
7 (iii) the Executive Director of the Board of
8 Higher Education or designee;
9 (iv) the Community College Board President or
10 designee;
11 (v) the State Board of Education State
12 Superintendent or designee; and
13 (vi) the Director of Central Management
14 Services or designee;
15 (2) up to 7 members who are appointed by the
16 Governor and who:
17 (i) have experience and background in private
18 K-12 education, private higher education, or who are
19 from other participant constituents that are not
20 already represented;
21 (ii) shall serve staggered terms up to 3 years
22 as designated by the Governor; and
23 (iii) shall serve until a successor is
24 appointed and qualified; and
25 (3) a Chairperson who is appointed by the Governor
26 and who shall serve a term of 2 years and until a
27 successor is appointed and qualified.
28 (b) Illinois Century Network Policy Committee members
29 shall serve without compensation but shall be entitled to
30 reimbursement for reasonable expenses of travel for members
31 who are required to travel for a distance greater than 20
32 miles to participate in business of the Illinois Century
33 Network Policy Committee. provided by the Board of Higher
34 Education, the Illinois Community College Board, the State

1 Board of Education, and other agencies as necessary or
2 warranted, using funds appropriated to these agencies for
3 this purpose.

6 Sec. 20. Illinois Century Network Policy Committee. The
7 Illinois Century Network Policy Committee shall set general
8 policies for the network. The Committee shall have the
9 following additional duties and powers:
10 (1) to purchase, acquire, or receive equipment and
11 agreements or contracts for services for the benefit of
12 the Illinois Century Network or its participants;
13 (2) to sell or convey equipment or services
14 desirable for Network operations to its participants at
15 reasonable costs incurred in the acquisition of the
16 equipment or services;
17 (3) to employ and fix the compensation for
18 employees as it deems reasonable to achieve the purposes
19 of this Act;
20 (4) to establish and maintain petty cash funds as
21 provided in Section 13.3 of the State Finance Act;
22 (5) to make, amend, and repeal bylaws, rules,
23 regulations, and resolutions that are consistent with
24 this Act;
25 (6) to make and execute all contracts and
26 instruments necessary or convenient to the exercise of
27 its powers;
28 (7) to exclusively control and manage the Network
29 and all moneys that are donated, paid, or appropriated
30 for the creation, improvement, and operation of the
31 Network;
32 (8) to prepare and submit a budget for the
33 necessary and contingent operation expenses of the

1 Network;
2 (9) to accept grants and funds from the federal and
3 state governments and any federal or state agency and to
4 expend those moneys in accordance and in furtherance of
5 the purposes of this Act;
6 (10) to enter into intergovernmental agreements
7 with other governmental entities, including but not
8 limited to, the Board of Higher Education, the Illinois
9 Community College Board, the State Board of Education,
10 the Department of Central Management Services, and local
11 education agencies, in order to implement and execute the
12 powers and duties set forth in this Act;
13 (11) to acquire or procure telecommunications or
14 computer networks or related services, alone or in
15 cooperation with other governmental or education
16 entities, as may be of reasonable benefit to the Network
17 or its participants for the general purposes set forth in
18 this Act; and
19 (12) to receive assignment of ownership or
20 management rights and the use of telecommunications
21 equipment and services owned or leased by the State of
22 Illinois or other entities providing services to Illinois
23 citizens for use in operation of Network programs and
24 services. consist of representatives from (i) the Office
25 of the Governor, appointed by the Governor, (ii) the
26 Board of Higher Education, appointed by the Board of
27 Higher Education, (iii) the Illinois Community College
28 Board, appointed by the Illinois Community College Board,
29 (iv) the State Board of Education, appointed by the State
30 Board of Education, and (v) other public and private
31 partners as are necessary, appointed by the Governor.

33 Section 99. Effective date. This Act takes effect upon
