1 AN ACT concerning legislative oversight of State
2 contracts.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Business Enterprise for Minorities,
6 Females, and Persons with Disabilities Act is amended by
7 adding Section 7.5 as follows:
8 (30 ILCS 575/7.5 new)
9 Sec. 7.5. Legislative Contract Compliance Oversight
10 Panel.
11 (a) The Legislative Contract Compliance Oversight Panel
12 is created, consisting of 6 members of the Genial Assembly
13 who serve by virtue of their office and are appointed as
14 follows:
15 (1) 2 Representatives appointed by the Speaker of
16 the House of Representatives.
17 (2) One Representative appointed by the Minority
18 Leader of the House of Representatives.
19 (3) 2 Senators appointed by the President of the
20 Senate.
21 (4) One Senator appointed by the Minority Leader of
22 the Senate.
23 Members serve at the pleasure of their appointing
24 authority. Annually, the members must select 2 from among
25 themselves to serve as co-chairs of the Panel. Members
26 receive no compensation for their service on the Panel but
27 may be reimbursed for their actual and reasonable expenses
28 from funds appropriated for that purpose.
29 (b) The Panel must oversee the compliance of the
30 Illinois Department of Transportation with the goals and
31 requirements of this Act in the awarding of State

1 construction contracts involving federal moneys or federal
2 reimbursement in whole or in part, directly or indirectly.
3 The Illinois Department of Transportation must provide the
4 Panel with copies of its compliance plan, contract notices,
5 and requests for exemptions and waivers under this Act. The
6 Illinois Department of Transportation must report quarterly
7 in writing to the Panel on its progress in meeting the goals
8 and requirements of this Act in its awarding of State
9 construction contracts involving federal moneys or federal
10 reimbursement.
11 (c) The Panel must conduct public forums periodically
12 throughout the State at which contractors subject to this Act
13 and other interested parties may comment upon and question
14 the compliance of the Illinois Department of Transportation
15 with the goals and requirements of this Act. The Panel may
16 request the attendance at the public forums of appropriate
17 representatives of the Department.
18 (d) The Panel must periodically report to the Business
19 Enterprise Council its findings and any recommendations
20 regarding the compliance of the Illinois Department of
21 Transportation with the goals and requirements of this Act.
22 Section 99. Effective date. This Act takes effect upon
23 becoming law.
