6 To the President of the Senate and the Speaker of the
7 House of Representatives:
8 We, the conference committee appointed to consider the
9 differences between the houses in relation to Senate
10 Amendment No. 1 to House Bill 5652, recommend the following:
11 (1) that the Senate recede from Senate Amendment No. 1;
12 and
13 (2) that House Bill 5652 be amended as follows:
14 on page 1, by inserting between lines 3 and 4 the following:
15 "Section 2. The Criminal Code of 1961 is amended by
16 changing Section 18-5 as follows:
17 (720 ILCS 5/18-5)
18 Sec. 18-5. Aggravated robbery.
19 (a) A person commits aggravated robbery when he or she
20 takes property from the person or presence of another by the
21 use of force or by threatening the imminent use of force
22 while falsely indicating verbally or by his or her actions to
23 the victim that he or she is presently armed with a firearm
24 or other dangerous weapon, including a knife, club, ax, or
25 bludgeon. This offense shall be applicable even though it is
26 later determined that he or she had no firearm or other
27 dangerous weapon, including a knife, club, ax, or bludgeon,
28 in his or her possession when he or she committed the
29 robbery.
30 (a-5) A person commits aggravated robbery when he or she
31 takes property from the person or presence of another by
32 delivering (by injection, inhalation, ingestion, transfer of

1 possession, or any other means) to the victim without his or
2 her consent, or by threat or deception, and for other than
3 medical purposes, any controlled substance.
4 (b) Sentence. Aggravated robbery is a Class 1 felony.

7 on page 5, in line 19, after "1999,", by inserting "or if
8 convicted of reckless homicide as defined in subsection (e-5)
9 of Section 9-3 of the Criminal Code of 1961 if the offense is
10 committed on or after the effective date of this amendatory
11 Act of the 92nd General Assembly,"; and
12 on page 16, by inserting below line 28 the following:
13 "Section 99. Effective date. This Section and Section 2
14 take effect upon becoming law.".
