1 AN ACT concerning land conveyances.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. Upon the payment of the sum of $10 to the
5 State of Illinois, the easement for highway purposes acquired
6 by the People of the State of Illinois is released over and
7 through the following described land in Lake County,
8 Illinois:
9 Parcel 1: That part of Lot 18 in School Trustees'
10 Subdivision in Section 16, Township 43 North, Range 12,
11 East of the Third Principal Meridian, lying Easterly of
12 the Easterly right-of-way line of Route 41 (known as
13 Skokie Highway), in Lake County, Illinois.
14 Parcel 2: That part of the Northeast Quarter of Section
15 21, Township 43 North, Range 12, East of the Third
16 Principal Meridian, lying Easterly of the Easterly
17 right-of-way line of Route 41 (known as Skokie Highway),
18 in Lake County, Illinois.
19 Excepting therefrom the following described parcel:
20 That part of Lot 18 in School Trustees Subdivision in the
21 Southeast Quarter of Section 16, Township 43 North, Range
22 12 East and part of the Northwest Quarter of Section 21,
23 Township 43 North, Range 12 East of the Third Principal
24 Meridian, described as commencing at the Northeast corner
25 of said Section 21; thence North 00 degrees, 00 minutes,
26 00 Seconds East (assumed) 1230.27 feet along the East
27 line of the Southeast Quarter of said Section 16 to the
28 point of beginning; thence North 89 degrees, 23 minutes,
29 17 seconds West 338.05 feet; thence South 00 degrees, 36
30 minutes, 43 seconds West 10.00 feet; thence North 89

10 seconds West 339.48 feet to said easterly right-of-way
11 line; thence North 25 degrees, 32 minutes, 30 seconds
12 West 2995.93 feet along said right-of-way line to the
13 North line of said Lot 18; thence South 89 degrees, 26
14 minutes, 59 seconds East 1308.00 feet to the East line of
15 the Southeast Quarter of said Section 16; thence South 00
16 degrees, 00 minutes, 00 seconds East 94.81 feet along
17 said east line to said point of beginning.
18 Access Control Line:
19 That part of the Northeast Quarter of Section 21,
20 Township 43 North, Range 12 East of the Third Principal
21 Meridian and the Southeast Quarter of Section 16,
22 Township 43 North, Range 12 East of the Third Principal
23 Meridian described as beginning on the East line of the
24 Northeast Quarter of said Section 21, 339.46 feet North
25 (as measured along said East line) of the Northeasterly
26 right-of-way line of U.S. Route 41 (Skokie Highway) per
27 Document No. 385225; thence North 25 degrees, 32 minutes,
28 30 seconds West 1923.92 feet parallel with and 150.00
29 feet Easterly of said right-of-way; thence North 40
30 degrees, 49 minutes, 13 seconds East 384.20 feet; thence
31 North 00 degrees, 36 minutes, 43 seconds East 225.98
32 feet; thence South 89 degrees, 23 minutes, 17 seconds
33 East 250.00 feet to the point of terminus, in Lake

2 Section 7. The release of easement under Section 5 is
3 subject to the City of Highland Park owning all other right,
4 title, and interest in the real estate underlying the
5 easement.
6 Section 8. If the real estate underlying the easement is
7 ever used for anything other than conservation and
8 recreational purposes, then the State of Illinois, with
9 respect to the easement only, has a right of re-entry for
10 breach of condition subsequent.
11 Section 9. The purpose of this Act is to ensure that the
12 subject property shall be used as open space solely for
13 conservation and recreational purposes.
14 The release of easement contemplated by this Act shall be
15 accomplished pursuant to an intergovernmental agreement among
16 the State of Illinois, the Department of Transportation, the
17 Department of Natural Resources, and the City of Highland
18 Park in which the City shall be required to provide
19 assurances satisfactory to the Departments that the property
20 shall be used only for the purposes of this Act.
21 Section 10. The Secretary of Transportation shall obtain
22 a certified copy of this Act within 60 days after its
23 effective date and, upon receipt of the required payment and
24 full execution of the required intergovernmental agreement,
25 shall record the certified document in the Recorder's Office
26 of Lake County, Illinois.
27 Section 99. Effective date. This Act takes effect upon
28 becoming law.
