1 AMENDMENT TO HOUSE BILL 5281
2 AMENDMENT NO. . Amend House Bill 5281 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Nursing and Advanced Practice Nursing
5 Act is amended by changing Section 20-40 as follows:
6 (225 ILCS 65/20-40)
7 (Section scheduled to be repealed on January 1, 2008)
8 Sec. 20-40. Fund. There is hereby created within the
9 State Treasury the Nursing Dedicated and Professional Fund.
10 The monies in the Fund may be used by and at the direction of
11 the Department for the administration and enforcement of this
12 Act, including but not limited to:
13 (a) Distribution and publication of the Nursing and
14 Advanced Practice Nursing Act and the rules at the time
15 of renewal to all persons licensed by the Department
16 under this Act.
17 (b) Employment of secretarial, nursing,
18 administrative, enforcement, and other staff for the
19 administration of this Act.
20 (c) Conducting a survey, as prescribed by rule of
21 the Department, once every 4 years during the license
22 renewal period.

1 (d) Conducting of training seminars for licensees
2 under this Act relating to the obligations,
3 responsibilities, enforcement and other provisions of the
4 Act and its rules.
5 (d-5) Establishment of a nursing image program to
6 educate the general public about the critical role nurses
7 play in the delivery of health services to result in the
8 recruitment of a greater number of persons entering the
9 profession. The program established by the Department
10 shall be developed and implemented in collaboration with
11 the Illinois Nurses Association and the Illinois
12 Coalition for Nursing Resources.
13 (e) Disposition of Fees:
14 (i) (Blank).
15 (ii) All of the fees and fines collected
16 pursuant to this Act shall be deposited in the
17 Nursing Dedicated and Professional Fund.
18 (iii) For the fiscal year beginning July 1,
19 1988, the moneys deposited in the Nursing Dedicated
20 and Professional Fund shall be appropriated to the
21 Department for expenses of the Department and the
22 Board in the administration of this Act. All
23 earnings received from investment of moneys in the
24 Nursing Dedicated and Professional Fund shall be
25 deposited in the Nursing Dedicated and Professional
26 Fund and shall be used for the same purposes as fees
27 deposited in the Fund.
28 (iv) For the fiscal year beginning July 1,
29 2001 and for each fiscal year thereafter, $750,000
30 of the moneys deposited in the Nursing Dedicated and
31 Professional Fund each year shall be set aside and
32 appropriated to the Illinois Department of Public
33 Health for nursing scholarships awarded pursuant to
34 the Nursing Education Scholarship Law.

1 Representatives of the Department and the Nursing
2 Education Scholarship Program Advisory Council shall
3 review this requirement and the scholarship awards
4 every 2 years.
5 (iv-5) For the fiscal year beginning July 1,
6 2002, $3,500,000 of the moneys deposited into the
7 Nursing Dedicated and Professional Fund shall be
8 appropriated to the Department to be used within 2
9 fiscal years of the effective date of this
10 amendatory Act of the 92nd General Assembly to
11 accomplish the goals set forth in subsection (d-5)
12 of this Section.
13 (v) Moneys in the Fund may be transferred to
14 the Professions Indirect Cost Fund as authorized
15 under Section 2105-300 of the Department of
16 Professional Regulation Law (20 ILCS 2105/2105-300).

18 Section 99. Effective date. This Act takes effect upon
19 becoming law.".
