1 AN ACT in relation to health.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Lead Poisoning Prevention Act is amended
5 by adding Section 2.5 as follows:
6 (410 ILCS 45/2.5 new)
7 Sec. 2.5. Study by Department and State Board of
8 Education.
9 (a) Based on the strong correlation between lead
10 poisoning and learning disabilities in children identified by
11 the U.S. Department of Health and Human Services as well as
12 the Centers for Disease Control and other states, the
13 Department shall conduct a comprehensive study to
14 conclusively establish the direct correlation between
15 Illinois school districts with high levels of lead poisoning
16 and high levels of learning-disabled students. Specifically,
17 the Department shall organize previously collected Department
18 data on lead poisoning according to State school districts.
19 Concurrently, the Illinois State Board of Education shall
20 organize its previously collected data on learning
21 disabilities according to State school districts and release
22 this information to the Department. This data shall then be
23 cross-referenced by the Department to produce a list of which
24 school districts have the highest number of learning-disabled
25 students due to lead poisoning.
26 In addition, based on the results of the study, the
27 Department shall do the following:
28 (1) Determine whether this Act in its current form
29 is sufficient to abate the lead poisoning or whether the
30 provisions of this Act should be expanded to accomplish
31 that result.

1 (2) Calculate (i) the cost of this abatement to the
2 State versus (ii) the monetary and social benefit of
3 reducing the number of learning-disabled children who
4 require additional education because of their
5 disabilities.
6 (b) The Department and the Illinois State Board of
7 Education shall complete the study by January 1, 2003 and
8 shall promptly thereafter submit the results of the study to
9 the General Assembly for its review.
10 Section 99. Effective date. This Act takes effect upon
11 becoming law.
