1 AN ACT in relation to vehicles.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by
5 changing Sections 15-102, 15-107, and 15-111 as follows:
6 (625 ILCS 5/15-102) (from Ch. 95 1/2, par. 15-102)
7 Sec. 15-102. Width of Vehicles.
8 (a) On Class III and non-designated State and local
9 highways, the total outside width of any vehicle or load
10 thereon shall not exceed 8 feet.
11 (b) Except during those times when, due to insufficient
12 light or unfavorable atmospheric conditions, persons and
13 vehicles on the highway are not clearly discernible at a
14 distance of 1000 feet, the following vehicles may exceed the
15 8 feet limitation during the period from a half hour before
16 sunrise to a half hour after sunset:
17 (1) Loads of hay, straw or other similar farm
18 products provided that the load is not more than 12 feet
19 wide.
20 (2) Implements of husbandry being transported on
21 another vehicle and the transporting vehicle while
22 loaded.
23 The following requirements apply to the
24 transportation on another vehicle of an implement of
25 husbandry wider than 8 feet 6 inches on the National
26 System of Interstate and Defense Highways or other
27 highways in the system of State highways:
28 (A) The driver of a vehicle transporting an
29 implement of husbandry that exceeds 8 feet 6 inches
30 in width shall obey all traffic laws and shall check
31 the roadways prior to making a movement in order to

1 ensure that adequate clearance is available for the
2 movement. It is prima facie evidence that the
3 driver of a vehicle transporting an implement of
4 husbandry has failed to check the roadway prior to
5 making a movement if the vehicle is involved in a
6 collision with a bridge, overpass, fixed structure,
7 or properly placed traffic control device or if the
8 vehicle blocks traffic due to its inability to
9 proceed because of a bridge, overpass, fixed
10 structure, or properly placed traffic control
11 device.
12 (B) Flags shall be displayed so as to wave
13 freely at the extremities of overwidth objects and
14 at the extreme ends of all protrusions, projections,
15 and overhangs. All flags shall be clean, bright red
16 flags with no advertising, wording, emblem, or
17 insignia inscribed upon them and at least 18 inches
18 square.
19 (C) "OVERSIZE LOAD" signs are mandatory on the
20 front and rear of all vehicles with loads over 10
21 feet wide. These signs must have 12-inch high black
22 letters with a 2-inch stroke on a yellow sign that
23 is 7 feet wide by 18 inches high.
24 (D) One civilian escort vehicle is required
25 for a load that exceeds 14 feet 6 inches in width
26 and 2 civilian escort vehicles are required for a
27 load that exceeds 16 feet in width on the National
28 System of Interstate and Defense Highways or other
29 highways in the system of State highways.
30 (E) The requirements for a civilian escort
31 vehicle and driver are as follows:
32 (1) The civilian escort vehicle shall be
33 a passenger car or a second division vehicle
34 not exceeding a gross vehicle weight of 8,000

1 pounds that is designed to afford clear and
2 unobstructed vision to both front and rear.
3 (2) The escort vehicle driver must be
4 properly licensed to operate the vehicle.
5 (3) While in use, the escort vehicle must
6 be equipped with illuminated rotating,
7 oscillating, or flashing amber lights or
8 flashing amber strobe lights mounted on top
9 that are of sufficient intensity to be visible
10 at 500 feet in normal sunlight.
11 (4) "OVERSIZE LOAD" signs are mandatory
12 on all escort vehicles. The sign on an escort
13 vehicle shall have 8-inch high black letters on
14 a yellow sign that is 5 feet wide by 12 inches
15 high.
16 (5) When only one escort vehicle is
17 required and it is operating on a two-lane
18 highway, the escort vehicle shall travel
19 approximately 300 feet ahead of the load. The
20 rotating, oscillating, or flashing lights or
21 flashing amber strobe lights and an "OVERSIZE
22 LOAD" sign shall be displayed on the escort
23 vehicle and shall be visible from the front.
24 When only one escort vehicle is required and it
25 is operating on a multilane divided highway,
26 the escort vehicle shall travel approximately
27 300 feet behind the load and the sign and
28 lights shall be visible from the rear.
29 (6) When 2 escort vehicles are required,
30 one escort shall travel approximately 300 feet
31 ahead of the load and the second escort shall
32 travel approximately 300 feet behind the load.
33 The rotating, oscillating, or flashing lights
34 or flashing amber strobe lights and an

1 "OVERSIZE LOAD" sign shall be displayed on the
2 escort vehicles and shall be visible from the
3 front on the lead escort and from the rear on
4 the trailing escort.
5 (7) When traveling within the corporate
6 limits of a municipality, the escort vehicle
7 shall maintain a reasonable and proper distance
8 from the oversize load, consistent with
9 existing traffic conditions.
10 (8) A separate escort shall be provided
11 for each load hauled.
12 (9) The driver of an escort vehicle shall
13 obey all traffic laws.
14 (10) The escort vehicle must be in safe
15 operational condition.
16 (11) The driver of the escort vehicle
17 must be in radio contact with the driver of the
18 vehicle carrying the oversize load.
19 (F) A transport vehicle while under load of
20 more than 8 feet 6 inches in width must be equipped
21 with an illuminated rotating, oscillating, or
22 flashing amber light or lights or a flashing amber
23 strobe light or lights mounted on the top of the cab
24 that are of sufficient intensity to be visible at
25 500 feet in normal sunlight. If the load on the
26 transport vehicle blocks the visibility of the amber
27 lighting from the rear of the vehicle, the vehicle
28 must also be equipped with an illuminated rotating,
29 oscillating, or flashing amber light or lights or a
30 flashing amber strobe light or lights mounted on the
31 rear of the load that are of sufficient intensity to
32 be visible at 500 feet in normal sunlight.
33 (G) When a flashing amber light is required on
34 the transport vehicle under load and it is operating

1 on a two-lane highway, the transport vehicle shall
2 display to the rear at least one rotating,
3 oscillating, or flashing light or a flashing amber
4 strobe light and an "OVERSIZE LOAD" sign. When a
5 flashing amber light is required on the transport
6 vehicle under load and it is operating on a
7 multilane divided highway, the sign and light shall
8 be visible from the rear.
9 (H) Maximum speed shall be 45 miles per hour
10 on all such moves or 5 miles per hour above the
11 posted minimum speed limit, whichever is greater,
12 but the vehicle shall not at any time exceed the
13 posted maximum speed limit.
14 (3) Portable buildings designed and used for
15 agricultural and livestock raising operations that are
16 not more than 14 feet wide and with not more than a 1
17 foot overhang along the left side of the hauling vehicle.
18 However, the buildings shall not be transported more than
19 10 miles and not on any route that is part of the
20 National System of Interstate and Defense Highways.
21 All buildings when being transported shall display at
22 least 2 red cloth flags, not less than 12 inches square,
23 mounted as high as practicable on the left and right side of
24 the building.
25 A State Police escort shall be required if it is
26 necessary for this load to use part of the left lane when
27 crossing any 2 laned State highway bridge.
28 (c) Vehicles propelled by electric power obtained from
29 overhead trolley wires operated wholly within the corporate
30 limits of a municipality are also exempt from the width
31 limitation.
32 (d) Exemptions are also granted to vehicles designed for
33 the carrying of more than 10 persons under the following
34 conditions:

1 (1) (Blank);
2 (2) When operated within any public transportation
3 service with the approval of local authorities or an
4 appropriate public body authorized by law to provide
5 public transportation. Any vehicle so operated may be 8
6 feet 6 inches in width; or
7 (3) When a county engineer or superintendent of
8 highways, after giving due consideration to the mass
9 transportation needs of the area and to the width and
10 condition of the road, has determined that the operation
11 of buses wider than 8 feet will not pose an undue safety
12 hazard on a particular county or township road segment,
13 he or she may authorize buses not to exceed 8 feet 6
14 inches in width on any highway under that engineer's or
15 superintendent's jurisdiction.
16 (e) A vehicle and load traveling upon the National
17 System of Interstate and Defense Highways or any other
18 highway in the system of State highways that has been
19 designated as a Class I or Class II highway by the
20 Department, or any street or highway designated by local
21 authorities or road district commissioners, may have a total
22 outside width of 8 feet 6 inches, provided that certain
23 safety devices that the Department determines as necessary
24 for the safe and efficient operation of motor vehicles shall
25 not be included in the calculation of width.
26 (e-1) A vehicle and load more than 8 feet wide but not
27 exceeding 8 feet 6 inches in width is allowed access
28 according to the following:
29 (1) A vehicle and load not exceeding the weight
30 limitations specified in subsection (f) of Section 15-111
31 73,280 pounds in weight is allowed access from any State
32 designated highway onto any county, township, or
33 municipal highway for a distance of 5 highway miles for
34 the purpose of loading, and unloading, food, fuel,

1 repairs, and rest, provided:
2 (A) The vehicle and load does not exceed 65
3 feet overall length.
4 (B) There is no sign prohibiting that access.
5 (C) The route is not being used as a
6 thoroughfare between State designated highways.
7 (2) (Blank) A vehicle and load not exceeding 73,280
8 pounds in weight is allowed access from any State
9 designated highway onto any county or township highway
10 for a distance of 5 highway miles or onto any municipal
11 highway for a distance of one highway mile for the
12 purpose of food, fuel, repairs, and rest, provided:
13 (A) The vehicle and load does not exceed 65
14 feet overall length.
15 (B) There is no sign prohibiting that access.
16 (C) The route is not being used as a
17 thoroughfare between State designated highways.
18 (3) A vehicle and load not exceeding 80,000 pounds
19 in weight is allowed access from a Class I highway onto
20 any street or highway for a distance of one highway mile
21 for the purpose of loading, unloading, food, fuel,
22 repairs, and rest, provided there is no sign prohibiting
23 that access.
24 (4) A vehicle and load not exceeding 80,000 pounds
25 in weight is allowed access from a Class I or Class II
26 highway onto any State highway or any locally designated
27 highway for a distance of 5 highway miles for the purpose
28 of loading, unloading, food, fuel, repairs, and rest.
29 (5) A trailer or semi-trailer not exceeding 28 feet
30 6 inches in length, that was originally in combination
31 with a truck tractor, shall have unlimited access to
32 points of loading and unloading.
33 (6) All household goods carriers shall have
34 unlimited access to points of loading and unloading.

1 Section 5-35 of the Illinois Administrative Procedure Act
2 relating to procedures for rulemaking shall not apply to the
3 designation of highways under this paragraph (e).
4 (f) Mirrors required by Section 12-502 of this Code and
5 other safety devices identified by the Department may project
6 up to 14 inches beyond each side of a bus and up to 6 inches
7 beyond each side of any other vehicle, and that projection
8 shall not be deemed a violation of the width restrictions of
9 this Section.
10 (g) Any person who is convicted of violating this
11 Section is subject to the penalty as provided in paragraph
12 (b) of Section 15-113.

15 Sec. 15-107. Length of vehicles.
16 (a) The maximum length of a single vehicle on any
17 highway of this State may not exceed 42 feet except the
18 following:
19 (1) Semitrailers.
20 (2) Charter or regulated route buses may be up to
21 45 feet in length, not including energy absorbing
22 bumpers.
23 (b) On all non-State highways, the maximum length of
24 vehicles in combinations is as follows:
25 (1) A truck tractor in combination with a
26 semitrailer may not exceed 55 feet overall dimension.
27 (2) A truck tractor-semitrailer-trailer may not
28 exceed 60 feet overall dimension.
29 (3) Combinations specially designed to transport
30 motor vehicles or boats may not exceed 60 feet overall
31 dimension.
32 Vehicles operating during daylight hours when
33 transporting poles, pipes, machinery, or other objects of a

1 structural nature that cannot readily be dismembered are
2 exempt from length limitations, provided that no object may
3 exceed 80 feet in length and the overall dimension of the
4 vehicle including the load may not exceed 100 feet. This
5 exemption does not apply to operation on a Saturday, Sunday,
6 or legal holiday. Legal holidays referred to in this Section
7 are the days on which the following traditional holidays are
8 celebrated: New Year's Day; Memorial Day; Independence Day;
9 Labor Day; Thanksgiving Day; and Christmas Day.
10 Vehicles and loads operated by a public utility while en
11 route to make emergency repairs to public service facilities
12 or properties are exempt from length limitations, provided
13 that during night operations every vehicle and its load must
14 be equipped with a sufficient number of clearance lamps on
15 both sides and marker lamps on the extreme ends of any
16 projecting load to clearly mark the dimensions of the load.
17 A tow truck in combination with a disabled vehicle or
18 combination of disabled vehicles, as provided in paragraph
19 (6) of subsection (c) of this Section, is exempt from length
20 limitations.
21 All other combinations not listed in this subsection (b)
22 may not exceed 60 feet overall dimension.
23 (c) Combinations of vehicles may not exceed a total of 2
24 vehicles except the following:
25 (1) A truck tractor semitrailer may draw one
26 trailer.
27 (2) A truck tractor semitrailer may draw one
28 converter dolly.
29 (3) A truck tractor semitrailer may draw one
30 vehicle that is defined in Chapter 1 as special mobile
31 equipment, provided the overall dimension does not exceed
32 60 feet.
33 (4) A truck in transit may draw 3 trucks in transit
34 coupled together by the triple saddlemount method.

1 (5) Recreational vehicles consisting of 3 vehicles,
2 provided the following:
3 (A) The total overall dimension does not
4 exceed 60 feet.
5 (B) The towing vehicle is a properly
6 registered vehicle capable of towing another vehicle
7 using a fifth-wheel type assembly.
8 (C) The second vehicle in the combination of
9 vehicles is a recreational vehicle that is towed by
10 a fifth-wheel assembly. This vehicle must be
11 properly registered and must be equipped with
12 brakes, regardless of weight.
13 (D) The third vehicle must be the lightest of
14 the 3 vehicles and be a trailer or semitrailer
15 designed or used for transporting a boat,
16 all-terrain vehicle, personal watercraft, or
17 motorcycle.
18 (E) The towed vehicles may be only for the use
19 of the operator of the towing vehicle.
20 (F) All vehicles must be properly equipped
21 with operating brakes and safety equipment required
22 by this Code, except the additional brake
23 requirement in subdivision (C) of this subparagraph
24 (5).
25 (6) A tow truck in combination with a disabled
26 vehicle or combination of disabled vehicles, provided the
27 towing vehicle:
28 (A) Is specifically designed as a tow truck
29 having a gross vehicle weight rating of at least
30 18,000 pounds and equipped with air brakes, provided
31 that air brakes are required only if the towing
32 vehicle is towing a vehicle, semitrailer, or
33 tractor-trailer combination that is equipped with
34 air brakes. For the purpose of this subsection,

1 gross vehicle weight rating, or GVWR, means the
2 value specified by the manufacturer as the loaded
3 weight of the tow truck.
4 (B) Is equipped with flashing, rotating, or
5 oscillating amber lights, visible for at least 500
6 feet in all directions.
7 (C) Is capable of utilizing the lighting and
8 braking systems of the disabled vehicle or
9 combination of vehicles.
10 (D) Does not engage a tow exceeding 50 highway
11 miles from the initial point of wreck or disablement
12 to a place of repair. Any additional movement of the
13 vehicles may occur only upon issuance of
14 authorization for that movement under the provisions
15 of Sections 15-301 through 15-319 of this Code.
16 The Department may by rule or regulation prescribe
17 additional requirements regarding length limitations for a
18 tow truck towing another vehicle.
19 For purposes of this Section, a tow-dolly that merely
20 serves as substitute wheels for another legally licensed
21 vehicle is considered part of the licensed vehicle and not a
22 separate vehicle.
23 (d) On Class I highways there are no overall length
24 limitations on motor vehicles operating in combinations
25 provided:
26 (1) The length of a semitrailer, unladen or with
27 load, in combination with a truck tractor may not exceed
28 53 feet.
29 (2) The distance between the kingpin and the center
30 of the rear axle of a semitrailer longer than 48 feet, in
31 combination with a truck tractor, may not exceed 45 feet
32 6 inches.
33 (3) The length of a semitrailer or trailer, unladen
34 or with load, operated in a truck

1 tractor-semitrailer-trailer combination, may not exceed
2 28 feet 6 inches.
3 (4) Maxi-cube combinations, as defined in Chapter
4 1, may not exceed 65 feet overall dimension.
5 (5) Combinations of vehicles specifically designed
6 to transport motor vehicles or boats may not exceed 65
7 feet overall dimension. The length limitation is
8 inclusive of front and rear bumpers but exclusive of the
9 overhang of the transported vehicles, as provided in
10 paragraph (i) of this Section.
11 (6) Stinger steered semitrailer vehicles as defined
12 in Chapter 1, specifically designed to transport motor
13 vehicles or boats, may not exceed 75 feet overall
14 dimension. The length limitation is inclusive of front
15 and rear bumpers but exclusive of the overhang of the
16 transported vehicles, as provided in paragraph (i) of
17 this Section.
18 (7) A truck in transit transporting 3 trucks
19 coupled together by the triple saddlemount method may not
20 exceed 75 feet overall dimension.
21 Vehicles operating during daylight hours when
22 transporting poles, pipes, machinery, or other objects of a
23 structural nature that cannot readily be dismembered are
24 exempt from length limitations, provided that no object may
25 exceed 80 feet in length and the overall dimension of the
26 vehicle including the load may not exceed 100 feet. This
27 exemption does not apply to operation on a Saturday, Sunday,
28 or legal holiday. Legal holidays referred to in this Section
29 are the days on which the following traditional holidays are
30 celebrated: New Year's Day; Memorial Day; Independence Day;
31 Labor Day; Thanksgiving Day; and Christmas Day.
32 Vehicles and loads operated by a public utility while en
33 route to make emergency repairs to public service facilities
34 or properties are exempt from length limitations, provided

1 that during night operations every vehicle and its load must
2 be equipped with a sufficient number of clearance lamps on
3 both sides and marker lamps on the extreme ends of any
4 projecting load to clearly mark the dimensions of the load.
5 A tow truck in combination with a disabled vehicle or
6 combination of disabled vehicles, as provided in paragraph
7 (6) of subsection (c) of this Section, is exempt from length
8 limitations.
9 The length limitations described in this paragraph (d)
10 shall be exclusive of safety and energy conservation devices,
11 such as bumpers, refrigeration units or air compressors and
12 other devices, that the Department may interpret as necessary
13 for safe and efficient operation; except that no device
14 excluded under this paragraph shall have by its design or use
15 the capability to carry cargo.
16 Section 5-35 of the Illinois Administrative Procedure Act
17 relating to procedures for rulemaking shall not apply to the
18 designation of highways under this paragraph (d).
19 (e) On Class II highways there are no overall length
20 limitations on motor vehicles operating in combinations,
21 provided:
22 (1) The length of a semitrailer, unladen or with
23 load, in combination with a truck tractor, may not exceed
24 53 feet overall dimension.
25 (2) The distance between the kingpin and the center
26 of the rear axle of a semitrailer longer than 48 feet, in
27 combination with a truck tractor, may not exceed 45 feet
28 6 inches.
29 (3) A truck tractor-semitrailer-trailer combination
30 may not exceed 65 feet overall dimension.
31 (4) The length of a semitrailer or trailer, unladen
32 or with load, operated in a truck
33 tractor-semitrailer-trailer combination, may not exceed
34 28 feet 6 inches.

1 (5) Maxi-cube combinations, as defined in Chapter
2 1, may not exceed 65 feet overall dimension.
3 (6) A combination of vehicles, specifically
4 designed to transport motor vehicles or boats, may not
5 exceed 65 feet overall dimension. The length limitation
6 is inclusive of front and rear bumpers but exclusive of
7 the overhang of the transported vehicles, as provided in
8 paragraph (i) of this Section.
9 (7) Stinger steered semitrailer vehicles, as
10 defined in Chapter 1, specifically designed to transport
11 motor vehicles or boats, may not exceed 75 feet overall
12 dimension. The length limitation is inclusive of front
13 and rear bumpers but exclusive of the overhang of the
14 transported vehicles, as provided in paragraph (i) of
15 this Section.
16 (8) A truck in transit transporting 3 trucks
17 coupled together by the triple saddlemount method may not
18 exceed 75 feet overall dimension.

7 Local authorities and road district commissioners, with
8 respect to streets and highways under their jurisdiction, may
9 also by ordinance or resolution allow length limitations of
10 this subsection (e).
11 The length limitations described in this paragraph (e)
12 shall be exclusive of safety and energy conservation devices,
13 such as bumpers, refrigeration units or air compressors and
14 other devices, that the Department may interpret as necessary
15 for safe and efficient operation; except that no device
16 excluded under this paragraph shall have by its design or use
17 the capability to carry cargo.
18 (e-1) Combinations of vehicles not exceeding 65 feet
19 overall length are allowed access as follows:
20 (1) From any State designated highway onto any
21 county, township, or municipal highway for a distance of
22 5 highway miles for the purpose of loading, and
23 unloading, food, fuel, repairs, and rest, provided:
24 (A) The vehicle does not exceed the weight
25 limitations specified in subsection (f) of Section
26 15-111 73,280 pounds in gross weight and 8 feet 6
27 inches in width.
28 (B) There is no sign prohibiting that access.
29 (C) The route is not being used as a
30 thoroughfare between State designated highways.
31 (2) (Blank) From any State designated highway onto
32 any county or township highway for a distance of 5
33 highway miles or onto any municipal highway for a
34 distance of one highway mile for the purpose of food,

1 fuel, repairs, and rest, provided:
2 (A) The vehicle does not exceed 73,280 pounds
3 in gross weight and 8 feet 6 inches in width.
4 (B) There is no sign prohibiting that access.
5 (C) The route is not being used as a
6 thoroughfare between State designated highways.
7 (e-2) Except as provided in subsection (e-3),
8 combinations of vehicles over 65 feet in length, with no
9 overall length limitation except as provided in subsections
10 (d) and (e) of this Section, are allowed access as follows:
11 (1) From a Class I highway onto any street or
12 highway for a distance of one highway mile for the
13 purpose of loading, unloading, food, fuel, repairs, and
14 rest, provided there is no sign prohibiting that access.
15 (2) From a Class I or Class II highway onto any
16 State highway or any locally designated highway for a
17 distance of 5 highway miles for the purpose of loading,
18 unloading, food, fuel, repairs, and rest.
19 (e-3) Combinations of vehicles over 65 feet in length
20 operated by household goods carriers, with no overall length
21 limitations except as provided in subsections (d) and (e) of
22 this Section, have unlimited access to points of loading and
23 unloading.
24 Section 5-35 of the Illinois Administrative Procedure Act
25 relating to procedures for rulemaking shall not apply to the
26 designation of highways under this paragraph (e).
27 (f) On Class III and other non-designated State
28 highways, the length limitations for vehicles in combination
29 are as follows:
30 (1) Truck tractor-semitrailer combinations, must
31 comply with either a maximum 55 feet overall wheel base
32 or a maximum 65 feet extreme overall dimension.
33 (2) Semitrailers, unladen or with load, may not
34 exceed 53 feet overall dimension.

1 (3) No truck tractor-semitrailer-trailer
2 combination may exceed 60 feet extreme overall dimension.
3 (4) The distance between the kingpin and the center
4 axle of a semitrailer longer than 48 feet, in combination
5 with a truck tractor, may not exceed 42 feet 6 inches.
6 (g) Length limitations in the preceding subsections of
7 this Section 15-107 do not apply to the following:
8 (1) Vehicles operated in the daytime, except on
9 Saturdays, Sundays, or legal holidays, when transporting
10 poles, pipe, machinery, or other objects of a structural
11 nature that cannot readily be dismembered, provided the
12 overall length of vehicle and load may not exceed 100
13 feet and no object exceeding 80 feet in length may be
14 transported unless a permit has been obtained as
15 authorized in Section 15-301.
16 (2) Vehicles and loads operated by a public utility
17 while en route to make emergency repairs to public
18 service facilities or properties, but during night
19 operation every vehicle and its load must be equipped
20 with a sufficient number of clearance lamps on both sides
21 and marker lamps upon the extreme ends of any projecting
22 load to clearly mark the dimensions of the load.
23 (3) A tow truck in combination with a disabled
24 vehicle or combination of disabled vehicles, provided the
25 towing vehicle meets the following conditions:
26 (A) It is specifically designed as a tow truck
27 having a gross vehicle weight rating of at least
28 18,000 pounds and equipped with air brakes, provided
29 that air brakes are required only if the towing
30 vehicle is towing a vehicle, semitrailer, or
31 tractor-trailer combination that is equipped with
32 air brakes.
33 (B) It is equipped with flashing, rotating, or
34 oscillating amber lights, visible for at least 500

1 feet in all directions.
2 (C) It is capable of utilizing the lighting
3 and braking systems of the disabled vehicle or
4 combination of vehicles.
5 (D) It does not engage in a tow exceeding 50
6 miles from the initial point of wreck or
7 disablement.
8 The Department may by rule or regulation prescribe
9 additional requirements regarding length limitations for a
10 tow truck towing another vehicle.
11 For the purpose of this subsection, gross vehicle weight
12 rating, or GVWR, shall mean the value specified by the
13 manufacturer as the loaded weight of the tow truck. Legal
14 holidays referred to in this Section shall be specified as
15 the day on which the following traditional holidays are
16 celebrated:
17 New Year's Day;
18 Memorial Day;
19 Independence Day;
20 Labor Day;
21 Thanksgiving Day; and
22 Christmas Day.
23 (h) The load upon any vehicle operated alone, or the
24 load upon the front vehicle of a combination of vehicles,
25 shall not extend more than 3 feet beyond the front wheels of
26 the vehicle or the front bumper of the vehicle if it is
27 equipped with a front bumper. The provisions of this
28 subsection (h) shall not apply to any vehicle or combination
29 of vehicles specifically designed for the collection and
30 transportation of waste, garbage, or recyclable materials
31 during the vehicle's operation in the course of collecting
32 garbage, waste, or recyclable materials if the vehicle is
33 traveling at a speed not in excess of 15 miles per hour
34 during the vehicle's operation and in the course of

1 collecting garbage, waste, or recyclable materials. However,
2 in no instance shall the load extend more than 7 feet beyond
3 the front wheels of the vehicle or the front bumper of the
4 vehicle if it is equipped with a front bumper.
5 (i) The load upon the front vehicle of a combination of
6 vehicles specifically designed to transport motor vehicles
7 shall not extend more than 3 feet beyond the foremost part of
8 the transporting vehicle and the load upon the rear
9 transporting vehicle shall not extend more than 4 feet beyond
10 the rear of the bed or body of the vehicle. This paragraph
11 shall only be applicable upon highways designated in
12 paragraphs (d) and (e) of this Section.
13 (j) Articulated vehicles comprised of 2 sections,
14 neither of which exceeds a length of 42 feet, designed for
15 the carrying of more than 10 persons, may be up to 60 feet in
16 length, not including energy absorbing bumpers, provided that
17 the vehicles are:
18 1. operated by or for any public body or motor
19 carrier authorized by law to provide public
20 transportation services; or
21 2. operated in local public transportation service
22 by any other person and the municipality in which the
23 service is to be provided approved the operation of the
24 vehicle.

26 (k) Any person who is convicted of violating this
27 Section is subject to the penalty as provided in paragraph
28 (b) of Section 15-113.

33 (a) On non-designated highways, no vehicle or

1 combination of vehicles equipped with pneumatic tires may be
2 operated, unladen or with load, when the total weight
3 transmitted to the road surface exceeds 18,000 pounds on a
4 single axle or 32,000 pounds on a tandem axle with no axle
5 within the tandem exceeding 18,000 pounds except:
6 (1) when a different limit is established and
7 posted in accordance with Section 15-316 of this Code;
8 (2) vehicles for which the Department of
9 Transportation and local authorities issue overweight
10 permits under authority of Section 15-301 of this Code;
11 (3) tow trucks subject to the conditions provided
12 in subsection (d) may not exceed 24,000 pounds on a
13 single rear axle or 44,000 pounds on a tandem rear axle;
14 (4) any single axle of a 2-axle truck weighing
15 36,000 pounds or less and not a part of a combination of
16 vehicles, shall not exceed 20,000 pounds;
17 (5) any single axle of a 2-axle truck equipped with
18 a personnel lift or digger derrick, weighing 36,000
19 pounds or less, owned and operated by a public utility,
20 shall not exceed 20,000 pounds;
21 (6) any single axle of a 2-axle truck specially
22 equipped with a front loading compactor used exclusively
23 for garbage, refuse, or recycling may not exceed 20,000
24 pounds per axle, provided that the gross weight of the
25 vehicle does not exceed 40,000 pounds;
26 (7) a truck, not in combination and specially
27 equipped with a selfcompactor or an industrial roll-off
28 hoist and roll-off container, used exclusively for
29 garbage or refuse operations may, when laden, transmit
30 upon the road surface the following maximum weights:
31 22,000 pounds on a single axle; 40,000 pounds on a tandem
32 axle;
33 (8) a truck, not in combination and used
34 exclusively for the collection of rendering materials,

1 may, when laden, transmit upon the road surface the
2 following maximum weights: 22,000 pounds on a single
3 axle; 40,000 pounds on a tandem axle;
4 (9) tandem axles on a 3-axle truck registered as a
5 Special Hauling Vehicle, manufactured prior to or in the
6 model year of 2004 and first registered in Illinois prior
7 to January 1, 2005, with a distance greater than 72
8 inches but not more than 96 inches between any series of
9 2 axles, is allowed a combined weight on the series not
10 to exceed 36,000 pounds and neither axle of the series
11 may exceed 18,000 pounds. Any vehicle of this type
12 manufactured after the model year of 2004 or first
13 registered in Illinois after December 31, 2004 may not
14 exceed a combined weight of 32,000 pounds through the
15 series of 2 axles and neither axle of the series may
16 exceed 18,000 pounds;
17 (10) tandem axles on a 4-axle truck mixer, whose
18 fourth axle is a road surface engaging mixer trailing
19 axle, registered as a Special Hauling Vehicle, used
20 exclusively for the mixing and transportation of concrete
21 and manufactured prior to or in the model year of 2004
22 and first registered in Illinois prior to January 1,
23 2005, with a distance greater than 72 inches but not more
24 than 96 inches between any series of 2 axles, is allowed
25 a combined weight on the series not to exceed 36,000
26 pounds and neither axle of the series may exceed 18,000
27 pounds. Any vehicle of this type manufactured after the
28 model year of 2004 or first registered in Illinois after
29 December 31, 2004 may not exceed a combined weight of
30 32,000 pounds through the series of 2 axles and neither
31 axle of the series may exceed 18,000 pounds;
32 (11) 4-axle vehicles or a 5 or more axle
33 combination of vehicles: The weight transmitted upon the
34 road surface through any series of 3 axles whose centers

1 are more than 96 inches apart, measured between extreme
2 axles in the series, may not exceed those allowed in the
3 table contained in subsection (f) of this Section. No
4 axle or tandem axle of the series may exceed the maximum
5 weight permitted under this Section for a single or
6 tandem axle.
7 No vehicle or combination of vehicles equipped with other
8 than pneumatic tires may be operated, unladen or with load,
9 upon the highways of this State when the gross weight on the
10 road surface through any wheel exceeds 800 pounds per inch
11 width of tire tread or when the gross weight on the road
12 surface through any axle exceeds 16,000 pounds.
13 (b) On non-designated highways, the gross weight of
14 vehicles and combination of vehicles including the weight of
15 the vehicle or combination and its maximum load shall be
16 subject to the foregoing limitations and further shall not
17 exceed the following gross weights dependent upon the number
18 of axles and distance between extreme axles of the vehicle or
19 combination measured longitudinally to the nearest foot.

13 (c) Cities having a population of more than 50,000 may
14 permit by ordinance axle loads on 2 axle motor vehicles 33
15 1/2% above those provided for herein, but the increase shall
16 not become effective until the city has officially notified
17 the Department of the passage of the ordinance and shall not
18 apply to those vehicles when outside of the limits of the
19 city, nor shall the gross weight of any 2 axle motor vehicle
20 operating over any street of the city exceed 40,000 pounds.
21 (d) Weight limitations shall not apply to vehicles
22 (including loads) operated by a public utility when
23 transporting equipment required for emergency repair of
24 public utility facilities or properties or water wells.
25 A combination of vehicles, including a tow truck and a
26 disabled vehicle or disabled combination of vehicles, that
27 exceeds the weight restriction imposed by this Code, may be
28 operated on a public highway in this State provided that
29 neither the disabled vehicle nor any vehicle being towed nor
30 the tow truck itself shall exceed the weight limitations
31 permitted under this Chapter. During the towing operation,
32 neither the tow truck nor the vehicle combination shall
33 exceed 24,000 pounds on a single rear axle and 44,000 pounds

1 on a tandem rear axle, provided the towing vehicle:
2 (1) is specifically designed as a tow truck having
3 a gross vehicle weight rating of at least 18,000 pounds
4 and is equipped with air brakes, provided that air brakes
5 are required only if the towing vehicle is towing a
6 vehicle, semitrailer, or tractor-trailer combination that
7 is equipped with air brakes;
8 (2) is equipped with flashing, rotating, or
9 oscillating amber lights, visible for at least 500 feet
10 in all directions;
11 (3) is capable of utilizing the lighting and
12 braking systems of the disabled vehicle or combination of
13 vehicles; and
14 (4) does not engage in a tow exceeding 20 miles
15 from the initial point of wreck or disablement. Any
16 additional movement of the vehicles may occur only upon
17 issuance of authorization for that movement under the
18 provisions of Sections 15-301 through 15-319 of this
19 Code.
20 Gross weight limits shall not apply to the combination of
21 the tow truck and vehicles being towed. The tow truck
22 license plate must cover the operating empty weight of the
23 tow truck only. The weight of each vehicle being towed shall
24 be covered by a valid license plate issued to the owner or
25 operator of the vehicle being towed and displayed on that
26 vehicle. If no valid plate issued to the owner or operator of
27 that vehicle is displayed on that vehicle, or the plate
28 displayed on that vehicle does not cover the weight of the
29 vehicle, the weight of the vehicle shall be covered by the
30 third tow truck plate issued to the owner or operator of the
31 tow truck and temporarily affixed to the vehicle being towed.
32 The Department may by rule or regulation prescribe
33 additional requirements. However, nothing in this Code shall
34 prohibit a tow truck under instructions of a police officer

1 from legally clearing a disabled vehicle, that may be in
2 violation of weight limitations of this Chapter, from the
3 roadway to the berm or shoulder of the highway. If in the
4 opinion of the police officer that location is unsafe, the
5 officer is authorized to have the disabled vehicle towed to
6 the nearest place of safety.
7 For the purpose of this subsection, gross vehicle weight
8 rating, or GVWR, shall mean the value specified by the
9 manufacturer as the loaded weight of the tow truck.
10 (e) No vehicle or combination of vehicles equipped with
11 pneumatic tires shall be operated, unladen or with load, upon
12 the highways of this State in violation of the provisions of
13 any permit issued under the provisions of Sections 15-301
14 through 15-319 of this Chapter.
15 (f) On designated Class I, II, or III highways and the
16 National System of Interstate and Defense Highways, no
17 vehicle or combination of vehicles with pneumatic tires may
18 be operated, unladen or with load, when the total weight on
19 the road surface exceeds the following: 20,000 pounds on a
20 single axle; 34,000 pounds on a tandem axle with no axle
21 within the tandem exceeding 20,000 pounds; 80,000 pounds
22 gross weight for vehicle combinations of 5 or more axles; or
23 a total weight on a group of 2 or more consecutive axles in
24 excess of that weight produced by the application of the
25 following formula: W = 500 times the sum of (LN divided by
26 N-1) + 12N + 36, where "W" equals overall total weight on any
27 group of 2 or more consecutive axles to the nearest 500
28 pounds, "L" equals the distance measured to the nearest foot
29 between extremes of any group of 2 or more consecutive axles,
30 and "N" equals the number of axles in the group under
31 consideration.

6 Local authorities and road district highway
7 commissioners, with respect to streets and highways under
8 their jurisdiction, without additional fees, may also by
9 ordinance or resolution allow the weight limitations of this
10 subsection, provided the maximum gross weight on any one axle
11 shall not exceed 20,000 pounds and the maximum total weight
12 on any tandem axle shall not exceed 34,000 pounds, on
13 designated highways when appropriate regulatory signs giving
14 notice are erected upon the street or highway or portion of
15 any street or highway affected by the ordinance or
16 resolution.
17 The following are exceptions to the above formula:
18 (1) Two consecutive sets of tandem axles may carry
19 a total weight of 34,000 pounds each if the overall
20 distance between the first and last axles of the
21 consecutive sets of tandem axles is 36 feet or more.
22 (2) Vehicles for which a different limit is
23 established and posted in accordance with Section 15-316
24 of this Code.
25 (3) Vehicles for which the Department of
26 Transportation and local authorities issue overweight
27 permits under authority of Section 15-301 of this Code.
28 These vehicles are not subject to the bridge formula.
29 (4) Tow trucks subject to the conditions provided
30 in subsection (d) may not exceed 24,000 pounds on a
31 single rear axle or 44,000 pounds on a tandem rear axle.
32 (5) A tandem axle on a 3-axle truck registered as a
33 Special Hauling Vehicle, manufactured prior to or in the
34 model year of 2004, and registered in Illinois prior to

1 January 1, 2005, with a distance between 2 axles in a
2 series greater than 72 inches but not more than 96 inches
3 may not exceed a total weight of 36,000 pounds and
4 neither axle of the series may exceed 18,000 pounds.
5 (6) A truck not in combination, equipped with a
6 self compactor or an industrial roll-off hoist and
7 roll-off container, used exclusively for garbage or
8 refuse operations, may, when laden, transmit upon the
9 road surface, except when on part of the National System
10 of Interstate and Defense Highways, the following maximum
11 weights: 22,000 pounds on a single axle; 40,000 pounds on
12 a tandem axle; 36,000 pounds gross weight on a 2-axle
13 vehicle; 54,000 pounds gross weight on a 3-axle vehicle.
14 This vehicle is not subject to the bridge formula.
15 (7) Combinations of vehicles, registered as Special
16 Hauling Vehicles that include a semitrailer manufactured
17 prior to or in the model year of 2004, and registered in
18 Illinois prior to January 1, 2005, having 5 axles with a
19 distance of 42 feet or less between extreme axles, may
20 not exceed the following maximum weights: 18,000 pounds
21 on a single axle; 32,000 pounds on a tandem axle; and
22 72,000 pounds gross weight. This combination of vehicles
23 is not subject to the bridge formula. For all those
24 combinations of vehicles that include a semitrailer
25 manufactured after the effective date of this amendatory
26 Act of the 92nd General Assembly, the overall distance
27 between the first and last axles of the 2 sets of tandems
28 must be 18 feet 6 inches or more. Any combination of
29 vehicles that has had its cargo container replaced in its
30 entirety after December 31, 2004 may not exceed the
31 weights allowed by the bridge formula.
32 No vehicle or combination of vehicles equipped with other
33 than pneumatic tires may be operated, unladen or with load,
34 upon the highways of this State when the gross weight on the

1 road surface through any wheel exceeds 800 pounds per inch
2 width of tire tread or when the gross weight on the road
3 surface through any axle exceeds 16,000 pounds.
4 (f-1) A vehicle and load not exceeding the weight
5 limitations specified in subsection (f) 73,280 pounds is
6 allowed access as follows:
7 (1) From any State designated highway onto any
8 county, township, or municipal highway for a distance of
9 5 highway miles for the purpose of loading, and
10 unloading, food, fuel, repairs, and rest, provided:
11 (A) The vehicle and load does not exceed 8
12 feet 6 inches in width and 65 feet overall length.
13 (B) There is no sign prohibiting that access.
14 (C) The route is not being used as a
15 thoroughfare between State designated highways.
16 (2) (Blank) From any State designated highway onto
17 any county or township highway for a distance of 5
18 highway miles, or any municipal highway for a distance of
19 one highway mile for the purpose of food, fuel, repairs,
20 and rest, provided:
21 (A) The vehicle and load does not exceed 8
22 feet 6 inches in width and 65 feet overall length.
23 (B) There is no sign prohibiting that access.
24 (C) The route is not being used as a
25 thoroughfare between State designated highways.
26 (f-2) A vehicle and load greater than 73,280 pounds in
27 weight but not exceeding 80,000 pounds is allowed access as
28 follows:
29 (1) From a Class I highway onto any street or
30 highway for a distance of one highway mile for the
31 purpose of loading, unloading, food, fuel, repairs, and
32 rest, provided there is no sign prohibiting that access.
33 (2) From a Class I, II, or III highway onto any
34 State highway or any local designated highway for a

1 distance of 5 highway miles for the purpose of loading,
2 unloading, food, fuel, repairs, and rest.
3 Section 5-35 of the Illinois Administrative Procedure Act
4 relating to procedures for rulemaking shall not apply to the
5 designation of highways under this subsection.
6 (g) No person shall operate a vehicle or combination of
7 vehicles over a bridge or other elevated structure
8 constituting part of a highway with a gross weight that is
9 greater than the maximum weight permitted by the Department,
10 when the structure is sign posted as provided in this
11 Section.
12 (h) The Department upon request from any local authority
13 shall, or upon its own initiative may, conduct an
14 investigation of any bridge or other elevated structure
15 constituting a part of a highway, and if it finds that the
16 structure cannot with safety to itself withstand the weight
17 of vehicles otherwise permissible under this Code the
18 Department shall determine and declare the maximum weight of
19 vehicles that the structures can withstand, and shall cause
20 or permit suitable signs stating maximum weight to be erected
21 and maintained before each end of the structure. No person
22 shall operate a vehicle or combination of vehicles over any
23 structure with a gross weight that is greater than the posted
24 maximum weight.
25 (i) Upon the trial of any person charged with a
26 violation of subsections (g) or (h) of this Section, proof of
27 the determination of the maximum allowable weight by the
28 Department and the existence of the signs, constitutes
29 conclusive evidence of the maximum weight that can be
30 maintained with safety to the bridge or structure.

32 Section 99. Effective date. This Act takes effect
33 January 1, 2003.
