1 AN ACT in relation to criminal law.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Criminal Code of 1961 is amended by adding
5 Article 26.2 as follows:

7 ARTICLE 26.2. LOST OR MISSING CHILDREN
8 (720 ILCS 5/26.2-5 new)
9 Sec. 26.2-5. Lost or missing children.
10 (a) Every corporation, partnership, sole proprietorship,
11 organization, association, or other entity doing retail
12 business in this State, with 5 or more members or employees,
13 shall adopt a written plan for use by employees or members,
14 or both, to protect against the loss or kidnapping of minor
15 children from the premises at which the entity conducts
16 business. The plan shall provide for the immediate securing
17 of all entrances and exits to the premises whenever a report
18 is received that a child is missing on or from the premises.
19 (b) The plan shall be filed with the Office of the
20 Attorney General and shall remain on file with the Office
21 while the entity occupies the same premises. The Office of
22 Attorney General shall promulgate rules to notify all
23 entities described in this Section of the provisions and
24 requirements of this Section. Any entity described in this
25 Section that fails to comply with the requirements of this
26 Section is guilty of a petty offense and shall be fined not
27 more than $100. No entity described in this Section shall
28 incur civil liability for its acts or omissions, or both, in
29 attempting to comply with this Section.

1 Section 99. Effective date. This Act takes effect upon
2 becoming law.
