1 AN ACT concerning higher education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The University of Illinois Act is amended by
5 adding Section 7e-5 as follows:
6 (110 ILCS 305/7e-5 new)
7 Sec. 7e-5. In-state tuition charge.
8 (a) For tuition purposes, the Board of Trustees must
9 classify an individual who is not a citizen or permanent
10 resident of the United States as an Illinois resident, until
11 the individual establishes a residence outside of this State,
12 if all of the following conditions are met:
13 (1) The individual resided with his or her parent
14 or guardian while attending a public or private high
15 school in this State.
16 (2) The individual graduated from a public or
17 private high school or received the equivalent of a high
18 school diploma in this State.
19 (3) The individual resided in this State for at
20 least 3 years as of the date the individual graduated
21 from high school or received the equivalent of a high
22 school diploma.
23 (4) The individual registers as an entering student
24 in the University not earlier than the 2002 fall
25 semester.
26 (5) The individual provides to the University an
27 affidavit stating that the individual will file an
28 application to become a permanent resident of the United
29 States at the earliest opportunity the individual is
30 eligible to do so.
31 (b) An alien who is living in the United States under a

1 visa permitting permanent residence or who has applied to or
2 has a petition pending with the Immigration and
3 Naturalization Service to attain lawful status under federal
4 immigration law must be given the same privilege of
5 qualifying for resident status for tuition and fee purposes
6 as a citizen of the United States.
7 (c) A foreign student who is a resident of Mexico and
8 who demonstrates a financial need, after the financial
9 resources of the foreign student and the student's family are
10 considered, is entitled to pay tuition at the rate provided
11 for Illinois residents. The Board of Trustees shall adopt
12 rules governing the determination of financial need of
13 students under this subsection (c).
14 (d) An individual who is 18 years of age or under or is
15 a dependent and who, along with one of the individual's
16 parents, was formerly a resident of this State is entitled to
17 pay tuition at the rate provided for Illinois residents if
18 all of the following conditions are met:
19 (1) The individual and the parent with whom the
20 individual primarily resides change their legal residence
21 from this State to another state.
22 (2) The other parent, with whom the individual does
23 not primarily reside, continues to reside in this State
24 and is not delinquent on the payment of any child
25 support.
26 (e) This Section applies only to tuition for a term or
27 semester that begins on or after the effective date of this
28 amendatory Act of the 92nd General Assembly.
29 Section 10. The Southern Illinois University Management
30 Act is amended by adding Section 8d-5 as follows:

32 Sec. 8d-5. In-state tuition charge.

1 (a) For tuition purposes, the Board must classify an
2 individual who is not a citizen or permanent resident of the
3 United States as an Illinois resident, until the individual
4 establishes a residence outside of this State, if all of the
5 following conditions are met:

8 school in this State.
9 (2) The individual graduated from a public or
10 private high school or received the equivalent of a high

19 Section 15. The Chicago State University Law is amended
20 by adding Section 5-88 as follows:

22 Sec. 5-88. In-state tuition charge.
23 (a) For tuition purposes, the Board must classify an
24 individual who is not a citizen or permanent resident of the
25 United States as an Illinois resident, until the individual
26 establishes a residence outside of this State, if all of the
27 following conditions are met:
28 (1) The individual resided with his or her parent
29 or guardian while attending a public or private high
30 school in this State.
31 (2) The individual graduated from a public or
32 private high school or received the equivalent of a high

15 United States as an Illinois resident, until the individual
16 establishes a residence outside of this State, if all of the
17 following conditions are met:
18 (1) The individual resided with his or her parent
19 or guardian while attending a public or private high
20 school in this State.
21 (2) The individual graduated from a public or
22 private high school or received the equivalent of a high
23 school diploma in this State.
24 (3) The individual resided in this State for at
25 least 3 years as of the date the individual graduated
26 from high school or received the equivalent of a high
27 school diploma.
28 (4) The individual registers as an entering student
29 in the University not earlier than the 2002 fall
30 semester.
31 (5) The individual provides to the University an

33 Section 25. The Governors State University Law is

3 Sec. 15-88. In-state tuition charge.
4 (a) For tuition purposes, the Board must classify an
5 individual who is not a citizen or permanent resident of the
6 United States as an Illinois resident, until the individual
7 establishes a residence outside of this State, if all of the
8 following conditions are met:
9 (1) The individual resided with his or her parent
10 or guardian while attending a public or private high
11 school in this State.
12 (2) The individual graduated from a public or
13 private high school or received the equivalent of a high
14 school diploma in this State.

27 (a) For tuition purposes, the Board must classify an
28 individual who is not a citizen or permanent resident of the
29 United States as an Illinois resident, until the individual
30 establishes a residence outside of this State, if all of the
31 following conditions are met:
32 (1) The individual resided with his or her parent

6 Sec. 30-88. In-state tuition charge.
7 (a) For tuition purposes, the Board must classify an
8 individual who is not a citizen or permanent resident of the
9 United States as an Illinois resident, until the individual
10 establishes a residence outside of this State, if all of the
11 following conditions are met:
12 (1) The individual resided with his or her parent
13 or guardian while attending a public or private high
14 school in this State.
15 (2) The individual graduated from a public or
16 private high school or received the equivalent of a high
17 school diploma in this State.
18 (3) The individual resided in this State for at
19 least 3 years as of the date the individual graduated

22 (4) The individual registers as an entering student

27 Section 45. The Western Illinois University Law is
28 amended by adding Section 35-88 as follows:

30 Sec. 35-88. In-state tuition charge.
31 (a) For tuition purposes, the Board must classify an
32 individual who is not a citizen or permanent resident of the

2 establishes a residence outside of this State, if all of the
3 following conditions are met:
4 (1) The individual resided with his or her parent
5 or guardian while attending a public or private high
6 school in this State.

9 school diploma in this State.
