1 AMENDMENT TO HOUSE BILL 3382
2 AMENDMENT NO. . Amend House Bill 3382 as follows:
3 by replacing everything after the enacting clause with the
4 following:
5 "Section 5. The Illinois Vehicle Code is amended by
6 changing Sections 6-105 and 6-106 as follows:
7 (625 ILCS 5/6-105) (from Ch. 95 1/2, par. 6-105)
8 Sec. 6-105. Instruction permits and temporary licenses
9 for persons 18 years of age or older.
10 (a) Except as provided in this Section, the Secretary of
11 State upon receiving proper application and payment of the
12 required fee may issue an instruction permit to any person 18
13 years of age or older who is not ineligible for a license
14 under paragraphs 1, 3, 4, 5, 7, or 8 of Section 6-103, after
15 the applicant has successfully passed such examination as the
16 Secretary of State in his discretion may prescribe.
17 1. An instruction permit entitles the holder while
18 having the permit in his immediate possession to drive a
19 motor vehicle, excluding a motor driven cycle or
20 motorcycle, upon the highways for a period of 12 months
21 after the date of its issuance when accompanied by a
22 licensed driver who is 21 years of age or older, who has

1 had a valid driver's license classification to operate
2 such vehicle for at least one year and has had one year
3 of driving experience with such classification and who is
4 occupying a seat beside the driver.
5 2. A 12 month instruction permit for a motor driven
6 cycle or motorcycle may be issued to a person 18 years of
7 age or more, and entitles the holder to drive upon the
8 highways during daylight under the direct supervision of
9 a licensed motor driven cycle operator or motorcycle
10 operator with the same or greater classification, who is
11 21 years of age or older and who has at least one year of
12 driving experience.

15 (c) The Secretary of State may issue a temporary
16 driver's license to an applicant making an application for a
17 license permitting the operation of a motor vehicle for one
18 of the following reasons:
19 (1) The applicant is applying for a non-photo
20 driver's license for religious reasons or as a result of
21 facial disfigurement and is waiting for that application
22 to be processed.
23 (2) The applicant is prohibited by bona fide
24 religious convictions from applying for a social security
25 number, has made application for a driver's license using
26 a distinctive number in lieu of a social security number,
27 and is waiting for that application to be processed.
28 (3) There is a mechanical failure at the facility
29 that makes the issuance of a driver's license impossible.
30 (4) while the Secretary is completing an
31 investigation and determination of all facts relative to
32 such applicant's eligibility to receive such license, or
33 for Any other reason prescribed by rule or regulation
34 promulgated by the Secretary of State.

1 Such permit must be in the applicant's immediate
2 possession while operating a motor vehicle, and it shall be
3 invalid when the applicant's driver's license has been issued
4 or for good cause has been refused. In each case the
5 Secretary of State may issue the temporary driver's license
6 for such period as appropriate but in no event for longer
7 than 90 days. The Secretary shall adopt the rules necessary
8 to implement this subsection (c).

11 Sec. 6-106. Application for license or instruction
12 permit.
13 (a) Every application for any permit or license
14 authorized to be issued under this Act shall be made upon a
15 form furnished by the Secretary of State. Every application
16 shall be accompanied by the proper fee and payment of such
17 fee shall entitle the applicant to not more than 3 attempts
18 to pass the examination within a period of 1 year after the
19 date of application.
20 (b) Every application shall state the name, social
21 security number, zip code, date of birth, sex, and residence
22 address of the applicant; briefly describe the applicant;
23 state whether the applicant has theretofore been licensed as
24 a driver, and, if so, when and by what state or country, and
25 whether any such license has ever been cancelled, suspended,
26 revoked or refused, and, if so, the date and reason for such
27 cancellation, suspension, revocation or refusal; shall
28 include an affirmation by the applicant that all information
29 set forth is true and correct; and shall bear the applicant's
30 signature. The application form may also require the
31 statement of such additional relevant information as the
32 Secretary of State shall deem necessary to determine the
33 applicant's competency and eligibility. The Secretary of

1 State may in his discretion substitute a federal individual
2 tax identification number in lieu of a social security
3 number, or he may instead assign an additional distinctive
4 number in lieu thereof, where an applicant is prohibited by
5 bona fide religious convictions from applying or is exempt
6 from applying for a social security number, where the
7 applicant, upon proof from the Social Security
8 Administration, is ineligible to receive a social security
9 number, or where the applicant presents a federal individual
10 tax identification number; such information shall not be
11 shared with other governmental agencies or sold to marketing
12 entities or companies. The Secretary of State shall, however,
13 determine which religious orders or sects have such bona fide
14 religious convictions. The Secretary of State may, in his
15 discretion, by rule or regulation, provide that an
16 application for a drivers license or permit may include a
17 suitable photograph of the applicant in the form prescribed
18 by the Secretary, and he may further provide that each
19 drivers license shall include a photograph of the driver. The
20 Secretary of State may utilize a photograph process or system
21 most suitable to deter alteration or improper reproduction of
22 a drivers license and to prevent substitution of another
23 photo thereon.
24 (c) The application form shall include a notice to the
25 applicant of the registration obligations of sex offenders
26 under the Sex Offender Registration Act. The notice shall be
27 provided in a form and manner prescribed by the Secretary of
28 State. For purposes of this subsection (c), "sex offender"
29 has the meaning ascribed to it in Section 2 of the Sex
30 Offender Registration Act.
