1 AN ACT in relation to higher education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Board of Higher Education Act is amended
5 by changing Section 9.24 as follows:
6 (110 ILCS 205/9.24)
7 Sec. 9.24. Gender Sports Equity in Intercollegiate
8 Athletics. For the purpose of attaining gender equity in
9 intercollegiate athletics, public institutions of higher
10 education may grant, in addition to any such amounts
11 previously authorized by the Board, tuition waivers in an
12 amount not to exceed 1% of all tuition income.
13 Intercollegiate athletics, for purposes of this Section,
14 shall include only those sports sanctioned by the National
15 Collegiate Athletic Association and the National Association
16 of Intercollegiate Athletics, but shall not include club
17 sports.
18 Before issuing any such tuition waiver, public
19 institutions of higher education shall place on file with the
20 Board a plan for achieving gender equity in intercollegiate
21 athletics. The plan shall include, but not be limited to:
22 (1) intercollegiate sports opportunities available
23 to both men and women;
24 (2) activities to be undertaken by the institution
25 to achieve gender equity in intercollegiate athletics;
26 (3) identification of the barriers to achieving and
27 maintaining equitable intercollegiate athletic
28 opportunities for men and women;
29 (4) progress in achieving sports equity in
30 compliance with Title IX of the Education Amendments of
31 1972; and

1 (5) the use of tuition waivers for attaining gender
2 equity in intercollegiate sports.
3 The Board shall report every 3 years to the General
4 Assembly and the Governor, on or before the second Wednesday
5 of April, beginning in 2002, with a description of the plans
6 submitted by each public institution of higher education
7 relative to attainment of gender equity in intercollegiate
8 sports. The report shall include financial data on tuition
9 waivers and other intercollegiate athletic expenditures for
10 men and women, the effectiveness of the plans, and the degree
11 of compliance with Title IX of the Higher Education Act of
12 1965.
