1 AN ACT concerning schools.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Property Tax Code is amended by adding
5 Section 15-167 as follows:
6 (35 ILCS 200/15-167 new)
7 Sec. 15-167. Circuit breaker recipient. Property owned
8 and used exclusively as a home by a claimant under the Senior
9 Citizens and Disabled Persons Property Tax Relief and
10 Pharmaceutical Assistance Act is exempt from an increase in
11 the annual rate of tax levied by a school district for any
12 school purpose if the exemption is authorized by the school
13 board under Section 17-3.1a or 34-53a of the School Code.
14 Section 10. The School Code is amended by changing
15 Section 9-11 and adding Sections 17-3.1a and 34-53a as
16 follows:

18 Sec. 9-11. Tax rate increase - notice of election -
19 ballot. In addition to the notice requirements of the general
20 election law, whenever a proposition to increase a school tax
21 rate is submitted to be voted upon by the voters of any
22 district the notice of such election shall include an
23 estimate of the approximate amount of taxes extendible under
24 the maximum rate then in force and an estimate of the
25 approximate amount of taxes extendible under the proposed
26 increased rate, such amounts being computed upon the last
27 known full, fair cash value; provided that any error,
28 miscalculation or inaccuracy in computing such amounts shall
29 not invalidate or affect the validity of any rate so

1 increased. The board of directors shall make such estimate
2 and the secretary shall certify such amount to the election
3 authority as part of the certification of the proposition as
4 required by the general election law. Such estimate shall
5 appear on the ballot on which the proposition is printed, but
6 shall not appear as a part of the proposition.
7 In addition to all other notice requirements, if property
8 owned and used exclusively as a home by a claimant under the
9 Senior Citizens and Disabled Persons Property Tax Relief and
10 Pharmaceutical Assistance Act is to be exempted from a tax
11 rate increase as permitted under Section 17-3.1a or 34-53a of
12 this Code, the notice of the election shall include this
13 fact.

16 Sec. 17-3.1a. No increase in rate; circuit breaker
17 recipient. A school board in any school district having a
18 population of less than 500,000 inhabitants may, by proper
19 resolution, exempt property owned and used exclusively as a
20 home by a claimant under the Senior Citizens and Disabled
21 Persons Property Tax Relief and Pharmaceutical Assistance Act
22 from an increase in the annual rate of tax levied by the
23 school district for any school purpose before causing the
24 proposition to increase the tax rate to be submitted to the
25 voters. A person shall not be prohibited from voting on the
26 proposition because his or her property is to be exempted as
27 permitted under this Section.

29 Sec. 34-53a. No increase in rate; circuit breaker
30 recipient. The board may, by proper resolution, exempt
31 property owned and used exclusively as a home by a claimant
32 under the Senior Citizens and Disabled Persons Property Tax

1 Relief and Pharmaceutical Assistance Act from an increase in
2 the annual rate of tax levied by the school district for any
3 school purpose before causing the proposition to increase the
4 tax rate to be submitted to the voters. A person shall not
5 be prohibited from voting on the proposition because his or
6 her property is to be exempted as permitted under this
7 Section.
8 Section 99. Effective date. This Act takes effect upon
9 becoming law.
