1 AN ACT concerning criminal law.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Criminal Code of 1961 is amended by
5 changing Section 20-1.1 as follows:
6 (720 ILCS 5/20-1.1) (from Ch. 38, par. 20-1.1)
7 Sec. 20-1.1. Aggravated Arson. (a) A person commits
8 aggravated arson when in the course of committing arson he
9 knowingly damages any real property, or any personal property
10 having a value of $150 or more, of another without that other
11 person's consent, including all or any part of a house
12 trailer, watercraft, motor vehicle, or railroad car, or
13 damages, partially or totally, any building or structure,
14 including any adjacent building or structure, and (1) he
15 knows or reasonably should know that one or more persons are
16 present therein or (2) any person suffers great bodily harm,
17 or permanent disability or disfigurement as a result of the
18 fire or explosion or (3) a fireman or policeman who is
19 present at the scene acting in the line of duty, is injured
20 as a result of the fire or explosion. For purposes of this
21 Section, property "of another" means a building or other
22 property, whether real or personal, in which a person other
23 than the offender has an interest that the offender has no
24 authority to defeat or impair, even though the offender may
25 also have an interest in the building or property.
26 (b) Sentence. Aggravated arson is a Class X felony.

28 Section 99. Effective date. This Act takes effect upon
29 becoming law.
