1 AN ACT concerning professional regulation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Plumbing License Law is amended
5 by changing Section 18 as follows:
6 (225 ILCS 320/18) (from Ch. 111, par. 1117)
7 Sec. 18. Local regulation; Department standards.
8 (1) It is hereby declared to be the policy of this State
9 that each city, town, village, township or county with a
10 water supply system or sewage disposal system or both should
11 so soon after the enactment of this Act as practicable, with
12 the advice of the State Department of Public Health, provide
13 by ordinance, bylaws or rules and regulations for the
14 materials, construction, alteration, and inspection of all
15 plumbing placed in or in connection with any building in any
16 such city, town, village, township, or county and to provide
17 for and appoint a competent Plumbing Inspector or more as
18 required. The Department may by rule establish voluntary
19 standards for the content and conduct of local plumbing
20 regulation and inspection programs and may evaluate and
21 certify local programs that are in compliance with the
22 voluntary standards. The Department may by rule establish
23 voluntary education, training, and experience standards for
24 Plumbing Inspectors and may certify Plumbing Inspectors who
25 are in compliance with the voluntary standards. Subject to
26 paragraph (3) nothing contained in this Act shall prohibit
27 any city, town, village, township or county from providing
28 for a Plumbing Inspector or from requiring permits for the
29 installation and repair of plumbing and collecting a fee
30 therefor. No person shall be appointed as a Plumbing
31 Inspector who is not a licensed plumber under this Act,

1 including persons employed as Plumbing Inspectors in home
2 rule units.
3 (2) The Department of Public Health shall conduct
4 inquiry in any city, town, village, township, or county or at
5 any other place in the State when reasonably necessary in the
6 judgment of the Director of the Department of Public Health
7 to safeguard the health of any person or persons in this
8 State, on account of piping or appurtenant appliances within
9 any building, or outside, when such piping and appliances are
10 for the use of plumbing as defined in this Act and for the
11 use of carrying sewage or waste within or from any building.
12 The Department of Public Health may conduct such
13 inquiries in any city, town, village, township or county in
14 this State by directing the Plumbing Inspector thereof to aid
15 in or conduct such inquiry or investigation in behalf of the
16 Department of Public Health or the Department of Public
17 Health may designate some other person or persons to conduct
18 such investigation.
19 (3) No city, town, village, township, or county may
20 charge or collect a fee for a permit for the installation or
21 repair of plumbing unless it also requires that the
22 installation or repairs be inspected by a competent plumbing
23 inspector upon completion. A home rule unit, with the
24 exception of a home rule municipality having a population of
25 1,000,000 or more, may not regulate the issuance of a permit
26 for the installation or repair of plumbing in a manner
27 inconsistent with the regulation by the State of the issuance
28 of permits for installation or repair of plumbing under this
29 Act. This subsection (3) of Section 18 is a limitation under
30 subsection (i) of Section 6 of Article VII of the Illinois
31 Constitution on the concurrent exercise by home rule units of
32 powers and functions exercised by the State.

1 Section 99. Effective date. This Act takes effect upon
2 becoming law.
