1 AN ACT concerning State fiscal years.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The State Finance Act is amended by changing
5 Section 25 as follows:
6 (30 ILCS 105/25) (from Ch. 127, par. 161)
7 Sec. 25. Fiscal year limitations.
8 (a) All appropriations are shall be available for
9 expenditure for the fiscal year or for a lesser period if the
10 Act making that appropriation so specifies. A deficiency or
11 emergency appropriation shall be available for expenditure
12 only through June 30 of the year when the Act making that
13 appropriation is enacted unless that Act otherwise provides.
14 (b) Outstanding liabilities as of June 30, payable from
15 appropriations which have otherwise expired, may be paid out
16 of the expiring appropriations during the 2-month period
17 ending at the close of business on August 31. Any service
18 involving professional or artistic skills or any personal
19 services by an employee whose compensation is subject to
20 income tax withholding must be performed as of June 30 of the
21 fiscal year in order to be considered an "outstanding
22 liability as of June 30" that is thereby eligible for payment
23 out of the expiring appropriation.
24 However, payment of tuition reimbursement claims under
25 Section 14-7.03 or 18-3 of the School Code may be made by the
26 State Board of Education from its appropriations for those
27 respective purposes for any fiscal year, even though the
28 claims reimbursed by the payment may be claims attributable
29 to a prior fiscal year, and payments may be made at the
30 direction of the State Superintendent of Education from the
31 fund from which the appropriation is made without regard to

1 any fiscal year limitations.
2 Medical payments may be made by the Department of
3 Veterans' Affairs from its appropriations for those purposes
4 for any fiscal year, without regard to the fact that the
5 medical services being compensated for by such payment may
6 have been rendered in a prior fiscal year.
7 Medical payments may be made by the Department of Public
8 Aid and child care payments may be made by the Department of
9 Human Services (as successor to the Department of Public Aid)
10 from appropriations for those purposes for any fiscal year,
11 without regard to the fact that the medical or child care
12 services being compensated for by such payment may have been
13 rendered in a prior fiscal year; and payments may be made at
14 the direction of the Department of Central Management
15 Services from the Health Insurance Reserve Fund and the Local
16 Government Health Insurance Reserve Fund without regard to
17 any fiscal year limitations.
18 Additionally, payments may be made by the Department of
19 Human Services from its appropriations, or any other State
20 agency from its appropriations with the approval of the
21 Department of Human Services, from the Immigration Reform and
22 Control Fund for purposes authorized pursuant to the
23 Immigration Reform and Control Act of 1986, without regard to
24 any fiscal year limitations.
25 (c) Further, payments may be made by the Department of
26 Public Health and the Department of Human Services (acting as
27 successor to the Department of Public Health under the
28 Department of Human Services Act) from their respective
29 appropriations for grants for medical care to or on behalf of
30 persons suffering from chronic renal disease, persons
31 suffering from hemophilia, rape victims, and premature and
32 high-mortality risk infants and their mothers and for grants
33 for supplemental food supplies provided under the United
34 States Department of Agriculture Women, Infants and Children

1 Nutrition Program, for any fiscal year without regard to the
2 fact that the services being compensated for by such payment
3 may have been rendered in a prior fiscal year.
4 (d) The Department of Public Health and the Department
5 of Human Services (acting as successor to the Department of
6 Public Health under the Department of Human Services Act)
7 shall each annually submit to the State Comptroller, Senate
8 President, Senate Minority Leader, Speaker of the House,
9 House Minority Leader, and the respective Chairmen and
10 Minority Spokesmen of the Appropriations Committees of the
11 Senate and the House, on or before December 31, a report of
12 fiscal year funds used to pay for services provided in any
13 prior fiscal year. This report shall document by program or
14 service category those expenditures from the most recently
15 completed fiscal year used to pay for services provided in
16 prior fiscal years.
17 (e) The Department of Public Aid and the Department of
18 Human Services (acting as successor to the Department of
19 Public Aid) shall each annually submit to the State
20 Comptroller, Senate President, Senate Minority Leader,
21 Speaker of the House, House Minority Leader, the respective
22 Chairmen and Minority Spokesmen of the Appropriations
23 Committees of the Senate and the House, on or before November
24 30, a report that shall document by program or service
25 category those expenditures from the most recently completed
26 fiscal year used to pay for (i) services provided in prior
27 fiscal years and (ii) services for which claims were received
28 in prior fiscal years.
29 (f) The Department of Human Services (as successor to
30 the Department of Public Aid) shall annually submit to the
31 State Comptroller, Senate President, Senate Minority Leader,
32 Speaker of the House, House Minority Leader, and the
33 respective Chairmen and Minority Spokesmen of the
34 Appropriations Committees of the Senate and the House, on or

1 before December 31, a report of fiscal year funds used to pay
2 for services (other than medical care) provided in any prior
3 fiscal year. This report shall document by program or
4 service category those expenditures from the most recently
5 completed fiscal year used to pay for services provided in
6 prior fiscal years.
7 (g) In addition, each annual report required to be
8 submitted by the Department of Public Aid under subsection
9 (e) shall include the following information with respect to
10 the State's Medicaid program:
11 (1) Explanations of the exact causes of the
12 variance between the previous year's estimated and actual
13 liabilities.
14 (2) Factors affecting the Department of Public
15 Aid's liabilities, including but not limited to numbers
16 of aid recipients, levels of medical service utilization
17 by aid recipients, and inflation in the cost of medical
18 services.
19 (3) The results of the Department's efforts to
20 combat fraud and abuse.
21 (h) As provided in Section 4 of the General Assembly
22 Compensation Act, any utility bill for service provided to a
23 General Assembly member's district office for a period
24 including portions of 2 consecutive fiscal years may be paid
25 from funds appropriated for such expenditure in either fiscal
26 year.
27 (i) An agency which administers a fund classified by the
28 Comptroller as an internal service fund may issue rules for:
29 (1) billing user agencies in advance based on
30 estimated charges for goods or services;
31 (2) issuing credits during the subsequent fiscal
32 year for all user agency payments received during the
33 prior fiscal year which were in excess of the final
34 amounts owed by the user agency for that period; and

1 (3) issuing catch-up billings to user agencies
2 during the subsequent fiscal year for amounts remaining
3 due when payments received from the user agency during
4 the prior fiscal year were less than the total amount
5 owed for that period.
6 User agencies are authorized to reimburse internal service
7 funds for catch-up billings by vouchers drawn against their
8 respective appropriations for the fiscal year in which the
9 catch-up billing was issued.
