1 AN ACT in relation to the Illinois work force.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Illinois FIRST Job Opportunities Initiative Act.
6 Section 5. Illinois FIRST Job Opportunities Initiative.
7 (a) For any construction contract with the value of
8 $1,000,000 or more funded in whole or part by Illinois FIRST
9 funds or by any State funds, the State of Illinois shall post
10 the following information pursuant to the procedures set
11 forth in subsection (c):
12 (1) the approximate number of apprenticeship and
13 journey-level hours that will be required and available
14 for each skilled and unskilled trade to be utilized
15 within any contract and subcontract to be awarded for
16 that project, and any other employment opportunity to be
17 made available pursuant to such contract or subcontract;
18 (2) the approximate period of time during which
19 work on any contract or subcontract will continue,
20 including the approximate beginning date that any
21 employment opportunity will arise pursuant to the
22 contract;
23 (3) the description and location of the
24 construction project; and
25 (4) the specific procedures that must be followed
26 to apply for any employment opportunities arising from
27 the contract or subcontract, including location and hours
28 of any union or other offices.
29 (b) Any prime contractor receiving any construction
30 contract with the value of $1,000,000 or more funded in whole
31 or part by Illinois FIRST funds or by any State funds shall,

1 on the date the contract is awarded by the State, supply the
2 Department of Employment Security with the employment
3 information specified in subsection (a); provided that for
4 any subcontract awarded during the duration of the contract,
5 the information specified in subsection (a) shall be provided
6 by the prime contractor on the date the subcontract is
7 awarded. Any such contract shall include the requirement for
8 the prime contractor to supply the information within the
9 timeframes set forth in this subsection.
10 (c) All employment opportunities required to be posted
11 under this Section shall be submitted by a prime contractor
12 to the Department of Employment Security, utilizing forms and
13 procedures developed and made available by the Department.
14 The Department of Employment Security shall, upon receipt of
15 such information from any prime contractor:
16 (1) post the information on an appropriate State of
17 Illinois Internet site;
18 (2) post the information with the job service
19 program maintained by the State;
20 (3) post the information with all Illinois
21 Employment and Training Centers throughout the State; and
22 (4) provide electronic links to the Illinois
23 Department of Transportation website and the Capital
24 Development Board website where the information, specific
25 to those agencies shall also be posted.
26 In addition, the information provided to the Department
27 of Employment Security shall be provided by the prime
28 contractor or his or her representative to any person who
29 seeks employment directly at the job site at an office or
30 trailer where site business is conducted. The information,
31 or reference as to how to obtain it, shall also be posted in
32 an easily accessible public place at the same location.
33 (d) Any prime contractor awarded a construction contract
34 with the value of $1,000,000 or more, funded in whole or part

1 by Illinois FIRST funds or by any State funds, shall submit a
2 monthly report to the State of Illinois that shall include
3 information as to the number of apprenticeship and
4 journey-level hours worked by race and gender in each skilled
5 and unskilled trade on all projects employing skilled or
6 unskilled labor during the preceding month. The Governor
7 shall designate an office within a State agency that shall be
8 responsible for the development and dissemination of a simple
9 reporting form, both in paper and electronic format, to be
10 utilized by all State agencies and prime contractors covered
11 under this Section and shall be further responsible for
12 monitoring compliance with the reporting requirements
13 specified in this subsection. Any report submitted pursuant
14 to this subsection shall be made available, at a nominal
15 charge, to any member of the public who requests a copy.
16 Section 99. Effective date. This Act takes effect upon
17 becoming law.
