1 AN ACT in relation to vehicles.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by
5 adding Section 16-108 as follows:
6 (625 ILCS 5/16-108 new)
7 Sec. 16-108. Claims of diplomatic immunity.
8 (a) This Section applies only to an individual who
9 displays to a law enforcement officer a driver's license
10 issued by the U.S. Department of State or that otherwise
11 claims immunities or privileges under Title 22, Chapter 6 of
12 the United States Code with respect to the individual's
13 violation of Section 9-3 or Section 9-3.2 of the Criminal
14 Code of 1961 or his or her violation of a traffic regulation
15 governing the movement of vehicles under this Code or a
16 similar provision of a local ordinance.
17 (b) If a driver subject to this Section is stopped by a
18 law enforcement officer who has probable cause to believe
19 that the driver has committed a violation described in
20 subsection (a) of this Section, the law enforcement officer
21 shall:
22 (1) As soon as possible, contact the U.S.
23 Department of State in order to verify the driver's
24 status and immunity, if any.
25 (2) Record all relevant information from any
26 driver's license or identification card, including a
27 driver's license or identification card issued by the
28 U.S. Department of State.
29 (3) Within 5 workdays after the date of the stop,
30 forward the following to the Secretary of State of
31 Illinois:

1 (A) A vehicle accident report, if the driver
2 was involved in a vehicle accident.
3 (B) If a citation or charge was issued to the
4 driver, a copy of the citation or charge.
5 (C) If a citation or charge was not issued to
6 the driver, a written report of the incident.
7 (c) Upon receiving material submitted under paragraph
8 (3) of subsection (b), the Secretary of State shall:
9 (1) File each vehicle accident report, citation or
10 charge, and incident report received.
11 (2) Keep convenient records or make suitable
12 notations showing each:
13 (A) conviction;
14 (B) disposition of court supervision for any
15 violation of Section 11-501 of this Code; and
16 (C) vehicle accident.
17 (3) Send a copy of each document and record
18 described in paragraph (2) of this subsection (c) to the
19 Bureau of Diplomatic Security, Office of Foreign
20 Missions, of the U.S. Department of State.
21 (d) This Section does not prohibit or limit the
22 application of any law to a criminal or motor vehicle
23 violation by an individual who has or claims immunities or
24 privileges under Title 22, Chapter 6 of the United States
25 Code.
26 Section 99. Effective date. This Act takes effect upon
27 becoming law.
