1 AN ACT in regard to vehicles.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by
5 changing Section 11-1426 as follows:
6 (625 ILCS 5/11-1426) (from Ch. 95 1/2, par. 11-1426)
7 Sec. 11-1426. Operation of all-terrain vehicles and
8 off-highway motorcycles on streets, roads and highways.
9 (a) Except as provided under this Section, it shall be
10 unlawful for any person to drive or operate any all-terrain
11 vehicle or off-highway motorcycle upon any street, highway or
12 roadway in this State.
13 (b) Except as provided under subsection (c) of this
14 Section, all-terrain vehicles and off-highway motorcycles may
15 make a direct crossing provided:
16 (1) The crossing is made at an angle of
17 approximately 90 degrees to the direction of the street,
18 road or highway and at a place where no obstruction
19 prevents a quick and safe crossing; and
20 (2) The all-terrain vehicle or off-highway
21 motorcycle is brought to a complete stop before
22 attempting a crossing; and
23 (3) The operator of the all-terrain vehicle or
24 off-highway motorcycle yields the right of way to all
25 pedestrian and vehicular traffic which constitutes a
26 hazard; and
27 (4) That when crossing a divided highway, the
28 crossing is made only at an intersection of the highway
29 with another public street, road, or highway; and
30 (5) That when accessing township roadways in
31 counties which contain a tract of the Shawnee National

1 Forest, the accessing complies with rules promulgated by
2 the Department of Natural Resources to govern the
3 accessing.
4 (b-1) All-terrain vehicles and off-highway motorcycles
5 may be operated on a roadway when it is necessary to cross a
6 2-lane bridge.
7 (c) No person operating an all-terrain vehicle or
8 off-highway motorcycle shall make a direct crossing upon or
9 across any tollroad, interstate highway, or controlled access
10 highway in this State.
11 (d) The corporate authorities of a county, road
12 district, township, city, village, or incorporated town may
13 adopt ordinances or resolutions allowing all-terrain vehicles
14 and off-highway motorcycles to be operated on roadways under
15 their jurisdiction, designated by signs as may be prescribed
16 by the Department, when it is necessary to cross a bridge to
17 which subsection (b-1) does not apply or a culvert or when it
18 is impracticable to gain immediate access to an area adjacent
19 to a highway where an all-terrain vehicle or off-highway
20 motorcycle is to be operated. The crossing shall be made in
21 the same direction as traffic.
22 (e) The corporate authorities of a county, road
23 district, township, city, village, or incorporated town may
24 adopt ordinances or resolutions designating one or more
25 specific public highways or streets under their jurisdiction
26 as egress and ingress routes for the use of all-terrain
27 vehicles and off-highway motorcycles. Operation of
28 all-terrain vehicles and off-highway motorcycles on the
29 routes shall be in the same direction as traffic. Corporate
30 authorities acting under the authority of this subsection (e)
31 shall erect and maintain signs, as may be prescribed by the
32 Department, giving proper notice of the designation.
